ARRANTY AND LIABILITY
Unless otherwise agreed in writing, the general terms and conditions of the Dutch Gymnastics
Equipment Manufacturers (NGF) are established at Leusden.
•The Supplier grants a warranty of five (5) years on the fixed built-in equipment and mobile equipment
supplied by them. This warranty does not apply to parts for accessories of fixed equipment such as
electric motors. A warranty period of one (1) year applies.
•The aforementioned five (5) year warranty is extended by five (5) years to ten (1 ) years if the client
has concluded a maintenance contract with the supplier regarding the goods delivered by the supplier,
on condition that:
a) the maintenance contract commences at the time of delivery of the relevant goods;
b) the maintenance contract continues during the (extended) warranty period;
c) at least once a year an inspection by the supplier has taken place on the goods to be
maintained;
d) the client enables the supplier to execute the agreed.
•The warranty does not cover defects caused by:
a) normal wear and tear;
b) improper or inappropriate use;
c) improper or incorrect maintenance;
d) changes or repairs made by or on behalf of the other party itself and/or carried out by third
parties;
e) errors by the client which can be demonstrated by the supplier;
f) errors wholly or partially due to government regulations regarding the quality or the nature of the
materials or with regard to the manufacture.
•In the event of defects occurring, the supplier will:
•replace the parts, the manufacturer becomes owner of the replaced parts;
•repair the defects;
•choose another alternative solution, if repair is not reasonably possible. The customer must give the
manufacturer the opportunity to remedy any defects.
•For built-in third-party components the warranty conditions of the relevant supplier apply. The warranty
period may vary from what is indicated above.
•Supplier reserves the right to change its equipment / installations without prior warning.
The execution and settlement of its warranty obligations will take place with due observance of the fact that
there is a so-called expiring warranty at all times; This means that the supplier will take into account the period
that has already elapsed after the delivery (deliveries) as well as the intensity with which the client has used
the delivered goods.
We draw attention to the following limitations of liability:
The supplier of the equipment is not liable for unsafe situations, accidents and damage resulting from, for
example:
•improper or incorrect use or maintenance;
•the use for other purposes or under other conditions than those specified in this documentation;
•insufficient or overdue maintenance;
•unauthorized repairing or changing specifications of the equipment;
•non-compliance with regulations and/or warnings as described in this user manual.
The supplier is also not liable:
•if the client does not, does not fully or not comply in time with an obligation from an existing
agreement or relationship with the supplier, or in case:
-of bankruptcy of the client;
-of suspension of payments on the part of the client;
-if a curator, administrator or liquidator has been appointed for the client;
-of debt restructuring on the part of the client;
-if the client has ceased its activities;
-if the control over the client has been acquired by a third party.
