1. UNPACK—Your Neoware thin client appliance is typically shipped with the following items:
• A mouse
• A power cable
• A stand for stabilizing your thin client appliance in a vertical orientation (attached)
• This Quick-Start Guide
2. SETUP—Your thin client appliance is designed to be installed in vertical orientation.
1. Connect the keyboard to the keyboard port.
2. Connect the mouse to the mouse port.
3. Depending on your configuration, connect your printer to the parallel port.
4. Connect the LAN cable to the 10/100 Based T Ethernet port.
5. Connect the AC cable to the power cord connector.
3. CONNECTIONS—Connect the supplied power cord, mouse, and keyboard to the ports
labeled 1, 8, and 9, respectively. Connect your monitor’s cable to the monitor port (5).

4. POWER UP—In order to turn on your appliance, push in the circular on/off button on its
front panel. To turn off your thin client appliance, push the on/off button again. (You may need
to hold the button in for 5 seconds, depending upon how the appliance is configured).

Neoware’s system RFI and Radiated Immunity tests were conducted with Neoware
supported peripheral devices and Neoware shielded cables, such as those you receive
with your system. Changes or modifications not expressly approved by Neoware could
void the user's authority to operate the equipment. To comply with the limits for an FCC
Class B computing device, always use shielded signal cables and the power cord sup-
plied with this unit.

Neoware Hardware Warranty
Neoware, Inc. (Neoware) warrants each Neoware hardware product to be free of mate-
rial hardware defects for 24 months from the date of shipment to the original purchas-
er, and will, at its option repair or replace any such defect according to the terms of this
Standard Warranty. Neoware's liability under this warranty shall be limited to such
repair or replacement. Neoware warrants only the base unit for such 24 month period.
Keyboards, mice, and related accessories are only warranted for the first 12 months
from the original date of shipment. Purchaser must register for warranty service at
Neoware's Web site for an additional warranty of 12 months, free of charge, for the
Neoware Base Unit only, at:
http://www.neoware.com/warranty/
The Purchaser must register within 90 days of ownership to take advantage of
this option.
Monitors or any external options sold by Neoware are warranted directly by and
through the monitor or options manufacturers, not by Neoware, and Neoware shall
have no responsibility or liability therefore.
Under this Standard Warranty, Neoware will, at Neoware's option, repair or replace
defective hardware products and related hardware components, during Neoware's nor-
mal working hours. Neoware will not ship replacement equipment until the defective
hardware or hardware component is received (freight prepaid by Purchaser) at the
Neoware factory or service depot, unless Neoware agrees in writing to do otherwise.
Neoware, at its option, may ship the replacement hardware product prior to its receipt
of the defective hardware product. The model and serial number of the defective hard-
ware product must be furnished by the Purchaser at the time of request for service
pursuant to this Standard Warranty. A return authorization number must be obtained
from the Neoware service department prior to returning the hardware to the factory.
This Standard Warranty shall be invalid if, in Neoware's sole judgment, the hardware
product or component has been subjected to misuse, abuse, neglect, accident, acts of
God, external electrical fault, power surges or failure, damage occurred in shipment,
acts outside the reasonable control of Neoware or its distributors and resellers, or from
improper service or modification by anyone other than a Neowareauthorized service
center. The Standard Warranty shall also be invalid if the hardware product's serial
number has been removed, defaced or altered in any way. This Standard Warranty
does not cover other manufacturers' computer hardware, components, accessories or
expansion items unless authorized in writing by Neoware.
The sole and exclusive remedy to purchaser, under this Standard Warranty, shall be
the repair or replacement of defective parts as provided above.
The procedure for obtaining service may vary outside the Continental United States.
Purchasers not located within the Continental United States desiring warranty service
must contact Neoware for such warranty service information.
ANYTHING TO THE CONTRARY HEREIN NOTWITHSTANDING, UNDER NO CIR-
CUMSTANCES SHALL NEOWARE ITS SUCCESSORS, ASSIGNS, OFFICERS,
DIRECTORS, EMPLOYEES AND AGENTS, UNDER ANY LEGAL THEORY, TORT,
CONTRACT OR OTHERWISE, BE LIABLE IN ANY WAY FOR DAMAGES HEREUN-
DER, INCLUDING, BUT NOT LIMITED TO, ANY LOSS OR INACCURACY OF DATA,
BUSINESS LOSS OR PROFITS, OR ANY OTHER DIRECT OR INDIRECT, SPE-

als, and "online" or electronic documentation ("SOFTWARE") are protected by United
States as well as international intellectual property laws and treaties. The SOFTWARE
is licensed, for use, not sold. All rights reserved.
IF YOU DO NOT AGREE TO THIS EULA, DO NOT USE THE DEVICE OR COPY
THE SOFTWARE. INSTEAD, PROMPTLY CONTACT NEOWARE FOR INSTRUC-

IS,"WITH NO WARRANTY. NEOWARE AND ITS SUPPLIERS DISCLAIM ALL
WARRANTIES EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATIONANY
IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICU-

• NOTE ON JAVA SUPPORT. The SOFTWARE may contain support for programs
written in Java. Java technology is not fault tolerant and is not designed, manufac-
tured, or intended for use or resale as online control equipment in hazardous envi-
ronments requiring fail-safe performance, such as in the operation of nuclear facili-
ties, aircraft navigation or communication systems, air traffic control, direct life sup-
port machines, or weapons systems, in which the failure of Java technology could
lead directly to death, personal injury, or severe physical or environmental damage.
Sun Microsystems, Inc. has contractually obligated NEOWARE to make this dis-
claimer, AND NEOWARE AND ITS SUPPLIERS SHALL HAVE NO LIABILITY OR
FAULT FOR ANY JAVA technology failures.
•TECHNICAL SUPPORT. At no additional charge, Neoware will provide technical
support for the SOFTWARE included with the DEVICE for a period of one (1) year
from the date of shipment. Technical Support includes commercially reasonable
efforts to provide assistance via telephone, Internet and fax with 1) problem determi-
nation, 2) technical questions related to the SOFTWARE and 3) work-arounds
and/or software updates made commercially available by Neoware. Technical
Support includes the provision of software updates of the Neoware SOFTWARE
(and the Neoware Remote Manager software) incorporating the licensed version of
the standard embedded Operating System. These version changes are designated
to the right of the decimal point (Rel.6.1) . Technical support excludes configuration
of any hardware, DEVICES or SOFTWARE, networking services, consulting servic-
es and general computer system maintenance. For an additional fee, Neoware will
provide specialized pre-installation or modification/engineering services according to
your specifications. Pricing for these additional services will be quoted by Neoware
upon request.
Neoware does not provide Technical Support for software components which are not
included as part of its standard software releases.
Software Upgrades, designated by release numbers to the left of the decimal point. (
Rel.6.0), are available from Neoware at a separate fee. After the initial one (1) year
term, Technical Support can be renewed by contacting Neoware.
• LIMITATIONS OF LIABILITIES AND EXCLUSIONS. TO THE MAXIMUM EXTENT
PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NEOWARE OR ITS
SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, PUNITIVE, INDIRECT,
OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMIT-
ED TO, DAMAGES FOR LOSS OF PROFITS OR CONFIDENTIAL OR OTHER

nently transfer rights under this EULA only as part of a permanent sale or transfer of
the DEVICE, and only if the recipient agrees to the provisions of this EULA express-
ly. If the SOFTWARE is an upgrade, or snap in, any transfer must also include all
prior versions of the SOFTWARE.
•EXPORT RESTRICTIONS. Regardless of any disclosure made by or to NEOWARE
of an ultimate destination of the SOFTWARE, you acknowledge the SOFTWARE is
subject to U.S. export control laws and jurisdiction. You acknowledge your exclusive
obligation to ensure that exports from the United States are in compliance with the
U.S. export control laws.You shall also be responsible for complying with all applica-
ble governmental regulations of any foreign countries with respect to the use of the
SOFTWARE outside of the United States.You agree that you will not submit the
SOFTWARE to any government agency for licensing consideration or other regulato-
ry approval without the prior written consent of NEOWARE. You shall defend, indem-
nify, and hold NEOWARE and its Suppliers harmless from and against any and all
claims, judgments, awards, and costs (including reasonable legal fees) arising out of
your noncompliance with applicable U.S. or foreign law with respect to the use or
unauthorized transfer of SOFTWARE by you.
•GOVERNING LAW. This EULA shall be governed by and controlled under the
Commonwealth of Pennsylvania law without reference to its conflicts of law princi-
pals. In the event of any conflicts between foreign law, rules, and regulations and
United States of America law, rules and regulations, United States of America Law,
rules and regulations shall prevail and govern. The United Nations Convention on
Contracts for the International Sales of goods shall not apply to this EULA.

RETRAIT DU SUPPORT—Si vous souhaitez utiliser le client léger dans une orientation horizontale, vous

En vertu de la présente garantie normale, Neoware aura la liberté de réparer ou de rem-
placer le matériel informatique et les composants informatiques connexes défectueux
pendant ses heures normales d'ouverture. Neoware n'expédiera pas de matériel de rem-
placement avant de recevoir le composant ou le matériel informatique défectueux (les
frais d'expédition seront prépayés par l'acheteur) à la fabrique Neoware ou au dépôt de

sera également invalide si le numéro de série du matériel informatique a été enlevé,
effacé ou altéré de quelque manière que ce soit. La présente garantie normale ne couvri-
ra pas le matériel informatique, les composants, les accessoires ou les articles d'expan-
sion d'autres fabricants, à moins que Neoware ne l'ait autorisé par écrit.
Le seul et exclusif recours de l'acheteur, en vertu de la présente garantie normale, sera

•SUPPORT TECHNIQUE. Sans frais supplémentaires, Neoware fournira l’assistance

période d’un (1) an, à compter de la date de livraison. Le support technique com-
prend les efforts commerciaux raisonnables destinés à mettre à disposition une
assistance via téléphone, Internet et télécopie, afin de : 1) Déterminer le problème,
2) Répondre aux questions techniques liées aux LOGICIELS et 3) Mettre à disposi-
tion des solutions de rechange et/ou des mises à jour logicielles, par l’intermédiaire
de Neoware. Le support technique inclut la provision de mises à jour des LOGI-
CIELS Neoware (et notamment du logiciel Remote Manager de Neoware), com-
prenant la version licence du système d’exploitation standard intégré. Ces change-
ments de version sont exprimés par un numéro à droite du point (Version 6.1). Le
support technique ne comprend pas la configuration de matériel, PERIPHERIQUE
ou LOGICIEL, les services réseau, les services de conseil et la maintenance
générale des systèmes. Moyennant frais additionnels, Neoware fournira des services
de pré installation et de modification/ingénierie, en fonction de vos spécificités. Les
tarifications de ces services supplémentaires seront fournies par Neoware sur
simple demande.
Neoware ne fournit pas de Support Technique pour des composants logiciels non
compris dans ses logiciels standards.
Les mises à niveau logicielles, désignées par des numéros de version signés à
gauche du point (version 6.0), sont disponibles auprès de Neoware et font l’objet
d’une facturation distincte. Après la période initiale d'un (1) an, l'assistance technique
peut être renouvelée en contactant Neoware.
•LIMITATIONS DE RESPONSABILITÉS ET EXCLUSIONS. DANS LES LIMITES

Si le LOGICIEL est une mise à niveau, ou un composant logiciel enfichable, tout
transfert doit également inclure les versions antérieures du LOGICIEL.
•RESTRICTIONS À L'EXPORTATION. Quelles que soient les déclarations faites par
ou à NEOWARE quant à la destination ultime du LOGICIEL, vous reconnaissez que
le LOGICIEL est soumis aux lois et à la juridiction de contrôle des exportations des
États-Unis. Vous déclarez et reconnaissez que le Logiciel est régi par les lois et
règlements des États-Unis relatifs au contrôle des exportations. Vous reconnaissez

Entfernen des Standfußes
Um den Thin Client in einer horizontalen Ausrichtung einzusetzen, können Sie den
mitgelieferten Standfuß wie folgt entfernen:
• Entfernen Sie sämtliche Kabel vom Gerät, die sich an der
Rückseite befinden.
• Drehen Sie das Gerät um 180 Grad und stellen Sie es auf die Oberseite.
• Heben Sie die Entriegelungstaste vorsichtig an, die sich in der Mitte des
Standfußes befindet.
• Schieben Sie den Standfuß in Richtung Rückseite des Gerätes bis
zum Anschlag.
• Entfernen Sie den Standfuß vom Gerät und verwahren Sie ihn an
einem sicheren Ort.
Gewährleistungsbestimmungen zur Hardware
von Neoware
Neoware, Inc. (Neoware) gewährleistet für einen Zeitraum von 24 Monaten ab
Versanddatum an den ursprünglichen Käufer, dass alle Hardware-Produkte von
Neoware frei von Hardwareschäden sind. Neoware repariert bzw. ersetzt jegliche
Schäden dieser Art gemäß diesen Standard-Gewährleistungsbestimmungen. Die
Haftung von Neoware in diesen Gewährleistungsbestimmungen ist auf Reparaturen
bzw. Ersatz dieser Art beschränkt. Neoware übernimmt in diesem Zeitraum von 24
Monaten nur eine Gewährleistung für die Grundeinheit. Für Tastaturen, Mäuse und
ähnliches Zubehör gilt die Gewährleistung nur für die ersten 12 Monate ab
Versanddatum. Der Käufer muss sich für den Garantie-Service auf der Website von
Neoware registrieren, wenn er eine zusätzliche kostenlose Gewährleistung für einen

Arbeitszeiten von Neoware. Neoware liefert keinen Ersatz vor Eingang der defekten
Hardware oder Hardware-Komponente im Werk von Neoware oder im Service-Depot
(Vorauszahlung der Frachtkosten durch den Käufer), sofern Neoware nicht schriftlich
etwas anderes erklärt. Neoware kann nach eigenem Ermessen die Ersatz-Hardware
vor Erhalt des defekten Hardware-Produkts liefern. Modell und Seriennummer des
defekten Hardware-Produkts sind vom Käufer zum Zeitpunkt der Inanspruchnahme
der Serviceleistungen gemäß diesen Standard-Gewährleistungsbestimmungen
anzugeben. Vor Einsendung der Hardware in die Fabrik muss eine
Einsendungsgenehmigungsnummer von der Neoware-Serviceabteilung beim Kunden
eingegangen sein.
Diese Standard-Gewährleistungsbestimmungen werden ungültig, wenn das Hardware-
Produkt oder die Komponente nach Ansicht von Neoware durch falsche Benutzung,
Missbrauch, Nachlässigkeit, Unfall, höhere Gewalt, externe elektrische Störungen,
Überspannung oder Stromausfall, Lieferschäden, Ereignisse, die nicht von Neoware
oder seinen Zulieferern und Fachhändlern beeinflusst werden können, oder durch
unsachgemäßen Service oder Modifizierung durch andere als die von Neoware
genehmigten Service-Center beschädigt wurde. Die Standard-
Gewährleistungsbestimmungen werden außerdem ungültig, wenn die Seriennummer
des Hardware-Produkts entfernt, unkenntlich gemacht oder auf irgendeine andere
Weise geändert wurde. Diese Standard-Gewährleistungs-bestimmungen betreffen
keine Computer-Hardware von anderen Herstellern; ebenso wenig deren
Komponenten, Zubehör oder Erweiterungsteile, sofern eine solche Gewährleistung
nicht schriftlich durch Neoware gewährt wurde. Das einzige Rechtsmittel für den
Käufer ist bei diesen Standard-Gewährleistungsbestimmungen der Ersatz oder die
Reparatur von defekten Teilen gemäß den obigen Bestimmungen.
Das Verfahren zur Inanspruchnahme von Serviceleistungen kann außerhalb des
Festlands der USA abweichen. Käufer, die sich nicht auf dem Festland der USA
befinden und Garantieleistungen in Anspruch nehmen möchten, müssen
Informationen zu den entsprechenden Garantieleistungen von Neoware anfordern.
SOFERN IN DIESER VEREINBARUNG NICHT AUSDRÜCKLICH ANDERS
GEREGELT, HAFTEN NEOWARE, SEINE NACHFOLGER,
ABTRETUNGSEMPFÄNGER, LEITENDEN MITARBEITER, DIREKTOREN, MITAR-
BEITER UND VERTRETER UNTER KEINEN UMSTÄNDEN, UNABHÄNGIG VON
DER RECHTSGRUNDLAGE, AUF DIE SICH SOLCHE ANSPRÜCHE STÜTZEN, SEI
ES UNLAUTERE HANDLUNG, VERTRAGSVERSCHULDEN ODER EINE ANDERE
GRUNDLAGE, IN IRGENDEINER WEISE FÜR SCHÄDEN, BEISPIELSWEISE UND
OHNE DARAUF BESCHRÄNKT ZU SEIN, FÜR DEN VERLUST ODER DIE UNGE-
NAUIGKEIT VON DATEN, GESCHÄFTSVERLUSTE ODER ENTGANGENE
GEWINNE ODER BELIEBIGE SONSTIGE DIREKTE ODER INDIREKTE, BESON-
DERE ODER BEGLEITSCHÄDEN, STRAFE EINSCHLIESSENDER SCHADENER-
SATZ, EXEMPLARISCHE ODER FOLGESCHÄDEN, DIE DURCH VERWENDUNG
DES PRODUKTS ENTSTEHEN, FÜR DAS DIESE STANDARDGEWÄHRLEISTUNG
GILT. IN KEINEM FALL HAFTEN NEOWARE, SEINE NACHFOLGER,
ABTRETUNGSEMPFÄNGER, LEITENDEN MITARBEITER, VERTRETER ODER
MITARBEITER GEGENÜBER EINER VERTRAGSPARTEI FÜR SCHÄDEN, DIE
ÜBER DEN BETRAG HINAUSGEHEN, DEN DIESE VERTRAGSPARTEI NEOWARE
FÜR DEN KAUF DER HARDWAREPRODUKTE GEZAHLT HAT, SELBST WENN
NEOWARE AUF DIE MÖGLICHKEIT SOLCHER SCHÄDEN HINGEWIESEN
WURDE; AUCH HAFTET NEOWARE NICHT FÜR SONSTIGE ANSPRÜCHE EINER
SOLCHEN VERTRAGSPARTEI.
NEOWARE SCHLIESST JEDE DIREKTE ODER INDIREKTE ZUSICHERUNG,
UNTER ANDEREM, OHNE DARAUF BESCHRÄNKT ZU SEIN, DIE IMPLIZITE
ZUSICHERUNG DER HANDELBARKEIT ODER EIGNUNG FÜR EINEN BES-
TIMMTEN ZWECK, IN DE UMFANG AUS, IN DEM EIN SOLCHER
GEWÄHRLEISTUNGSAUSSCHLUSS PER GESETZ ZULÄSSIG IST. NEOWARE
GIBT KEINE ZUSICHERUNGEN ZUR (NICHT-)VERLETZUNG DER RECHTE DRIT-
TER AN GEISTIGEM EIGENTUM, DIE MIT DEN HIERMIT ERWORBENEN HARD-
WAREPRODUKTEN ZUSAMMENHÄNGEN. NEOWARE HAT KEINE PERSON
ERMÄCHTIGT, ANDERE ZUSICHERUNGEN ODER GARANTIEN ABZUGEBEN, DIE
NICHT AUSDRÜCKLICH HIER ERWÄHNT SIND.
ES WIRD AUSDRÜCKLICH DARAUF HINGEWIESEN UND VEREINBART, DASS
JEDE EINZELNE KLAUSEL DIESER STANDARDGEWÄHRLEISTUNG, DIE EINEN
HAFTUNGSAUSSCHLUSS, EINEN AUSSCHLUSS VON GEWÄHRLEISTUNG ODER
SCHÄDEN DARSTELLT, VON DEN VERTRAGSPARTEIEN ALS UNABHÄNGIGE
UND ABTRENNBARE KLAUSEL BETRACHTET WIRD, DIE ALS EINZELKLAUSEL
DURCHGESETZT WERDEN KANN. MIT DER VERWENDUNG DER HARDWARE-
PRODUKTE UND KOMPONENTEN ERKLÄRT SICH DER KÄUFER MIT DIESER
STANDARDGEWÄHRLEISTUNG EINVERSTANDEN.

Entsorgung des Geräts zu kümmern, die per Gesetz oder gesetzlicher Bestimmung

Anfrage.
Endverbraucher-Lizenzvertrag
Sie haben ein Gerät („GERÄT“) erworben, das Software enthält, die von NEOWARE,
INC. („NEOWARE“) und von dessen Zulieferern und Lizenzgebern („Zulieferer“)
entwickelt und/oder lizenziert wurde. All diese Software-Produkte sowie damit zusam-
menhängende Medien, Druckmaterialien und „Online-Dokumente“ oder elektronische
Dokumente („SOFTWARE“) sind durch die Gesetze und Abkommen zum geistigen
Eigentum geschützt, die sowohl in den USA als auch international gelten. Die SOFT-
WARE wird für den Gebrauch lizenziert - nicht verkauft. Alle Rechte vorbehalten.
WENN SIE DIESEM ENDVERBRAUCHER-LIZENZVERTRAG („EULA“) NICHT ZUS-

Lizenz zu folgenden Bedingungen:
• Sie dürfen die SOFTWARE nur auf einem GERÄT verwenden.
• NICHT FEHLERTOLERANT: DIE SOFTWARE IST NICHT FEHLERTOLERANT.
• KEINE GEWÄHRLEISTUNG FÜR DIE SOFTWARE: DIE SOFTWARE WIRD SO
ZUR VERFÜGUNG GESTELLT „WIE SIE IST“ („AS IS“); OHNE
GEWÄHRLEISTUNG. NEOWARE UND ZULIEFERER LEHNEN JEDE DIREKTE
ODER INDIREKTE GEWÄHRLEISTUNG AB, U.A. JEGLICHE INDIREKTE
GEWÄHRLEISTUNG DAFÜR, DASS DIE PRODUKTE VON DURCHSCHNIT-
TLICHER QUALITÄT UND FÜR DEN NORMALEN GEBRAUCH GEEIGNET SIND;

VORGESEHENEN UMFANG.
• HINWEIS ZUR JAVA-UNTERSTÜTZUNG: Die SOFTWARE enthält möglicherweise
eine Unterstützung für mit Java geschriebene Programme. Die Java- Technologie ist
nicht fehlertolerant und nicht für den Gebrauch oder Wiederverkauf als Online-
Steuerungsausrüstung in gefährlichen Umgebungen, die betriebssicheres Arbeiten
erfordern, ausgelegt, hergestellt oder vorgesehen, z. B. beim Betrieb von kerntech-
nischen Anlagen, bei Flugzeugsteuerungs- oder Kommunikationssystemen, bei der
Flugsicherung, bei Lebenserhaltungssystemen oder bei Waffensystemen, bei denen
ein Versagen der Java-Technologie den unmittelbaren Tod, Personenschäden oder
starke körperliche oder Umweltschäden zur Folge haben könnte. Sun Microsystems,
Inc. verpflichtet NEOWARE vertraglich, diese Einschränkung zu treffen, UND
NEOWARE UND SEINE ZULIEFERER HAFTEN NICHT UND ÜBERNEHMEN
KEINE VERANTWORTUNG FÜR IRGENDWELCHE JAVA-Technologie-Störungen.
• TECHNISCHER SUPPORT: Neoware bietet für die zum Lieferzeitpunkt auf dem
ENDGERÄT enthaltene SOFTWARE für die Dauer von einem (1) Jahr kostenfreien
technischen Support. Der technische Support wird in einem angemessenen Umfang
angeboten und beinhaltet die Beratung per Telefon, Internet oder Fax inklusive 1)
Problemidentifikation, 2) Beantwortung technischer Fragen zur SOFTWARE sowie 3)
Bereitstellung provisorischer und/oder handelsüblicher Software-Updates durch
Neoware. Darüber hinaus stellt der technische Support Updates der Neoware
SOFTWARE (inklusive der Neoware Remote Manager Software) innerhalb der lizen-
zierten Version des implementierten Standard-Betriebssystems bereit.
Versionswechsel sind über die Ziffer rechts vom Dezimalpunkt der
Versionsbezeichnung angegeben. (z.B. Versionswechsel 6.1 auf 6.2) Vom technis-
chen Support ausgenommen sind die Konfiguration jeglicher Hardware –
ENDGERÄTE oder SOFTWARE, Netzwerk Dienstleistungen, weiterführende
Beratungsleistungen oder eine generelle System- Instandhaltung. Gegen eine zusät-
zliche Gebühr übernimmt Neoware jedoch spezielle Vorinstallationen, Modifikationen
oder technische Dienstleistungen gemäß Ihren Anforderungen. Preise für
entsprechende Dienstleistungen werden von Neoware auf Anfrage mitgeteilt.
Neoware übernimmt keinen technischen Support für Software-Komponenten, die
nicht Bestandteil ihrer Standard Softwareversionen sind.
Software Upgrades werden über die Ziffer links vom Dezimalpunkt der
Versionsbezeichnung angegeben und sind bei Neoware gegen eine separate
Gebühr erhältlich. (z.B. Upgrade von Version 6.x auf 7.x).
Nach dem Ablauf der kostenfreien Supportlaufzeit von einem (1) Jahr besteht die
Möglichkeit mit Neoware eine Verlängerung der technischen Support-Leistung zu
vereinbaren.

GEMÄSS DEN BESTIMMUNGEN DIESES EULA ODER JEGLICHEM
ZUSÄTZLICHEM EULA AUF DEN HÖHEREN DER BEIDEN BETRÄGE - DER
VON IHNEN GEZAHLTE KAUFPREIS FÜR DIE SOFTWARE ODER USD 5,00 -
BESCHRÄNKT, WOBEI DIES IHR EINZIGES RECHTSMITTEL IST. DIE VORSTE-
HENDEN BESCHRÄNKUNGEN, AUSSCHLÜSSE UND HAFTUNGSBEGRENZUN-
GEN GELTEN IN DEM NACH DEM ANWENDBAREN RECHT
GRÖSSTMÖGLICHEN MASS, AUCH WENN EIN RECHTSMITTEL DEN
WESENTLICHEN ZWECK VERFEHLT. ES WIRD AUSDRÜCKLICH DARAUF
HINGEWIESEN UND VEREINBART, DASS JEDE EINZELNE KLAUSEL DIESES
EULA, DIE EINEN HAFTUNGSAUSSCHLUSS, EINEN
GEWÄHRLEISTUNGSAUSSCHLUSS ODER EINEN AUSSCHLUSS VON
SCHÄDEN VORSIEHT, VON DEN VERTRAGSPARTEIEN ALS VON DEN
ANDEREN KLAUSELN UNABHÄNGIGE UND ABTRENNBARE KLAUSEL BETRA-
CHTET WIRD, DIE EINZELN DURCHGESETZT WERDEN KANN.
Einschränkungen zu Reverse Engineering, Dekompilierung und
Disassemblierung: Sie dürfen die Software nicht durch Reverse Engineering,
Dekompilierung oder Disassemblierung analysieren, sofern solche Maßnahmen
nicht nach dem geltenden Recht ausdrücklich zulässig sind.
ÜBERTRAGUNG DER SOFTWARE NUR MIT EINSCHRÄNKUNGEN: Sie dürfen
die Rechte nach diesem EULA nur im Rahmen eines Verkaufs oder einer dauer-
haften Übertragung des GERÄTES an Dritte übertragen, sofern der Empfänger sich
ausdrücklich mit den Klauseln dieses EULA einverstanden erklärt. Handelt es sich
bei der SOFTWARE um ein Upgrade oder ein Snap-in, müssen bei jeder Übertra-
gung auch alle früheren Versionen der SOFTWARE übergeben werden.
EXPORTBESCHRÄNKUNGEN: Unabhängig von Angaben, die NEOWARE zum
endgültigen Bestimmungsort der SOFTWARE macht, erklären Sie sich einver-
standen, dass die SOFTWARE dem US-Exportrecht und den US-
Exportkontrollgesetzen unterliegt. Sie bestätigen Ihre ausdrückliche Verpflichtung
sicherzustellen, dass Exporte aus den USA entsprechend den US-
Exportkontrollgesetzen erfolgen. Es obliegt Ihnen ebenfalls die Einhaltung aller
anwendbaren behördlichen Vorschriften des Auslands, die sich auf die Verwendung
der SOFTWARE außerhalb der USA beziehen. Sie erklären, dass Sie die SOFT-
WARE weder einer Behörde zur Lizenzierung anbieten noch ohne vorherige
schriftliche Zustimmung von NEOWARE eine sonstige amtliche Zulassung beantra-
gen. Sie werden NEOWARE und ihre Lieferanten gegen alle Ansprüche, Urteile,
Schiedssprüche, Kosten (einschließlich der angemessenen Anwaltskosten) schützen
und schadlos halten bzw. dafür entschädigen, die im Zusammenhang mit Ihrer
Nichtbeachtung des geltenden US-Rechts bzw. Auslandsrechts bei der Verwendung
oder nicht genehmigten Übertragung der SOFTWARE durch Sie entstehen.
GELTENDES RECHT: Dieser EULA unterliegt dem Recht des Bundesstaates
Pennsylvania und ist in diesem Sinne auszulegen. Konflikte mit anderen
Rechtsgrundsätzen werden nicht berücksichtigt. Bei eventuellen Konflikten mit aus-
ländischem Recht, ausländischen Vorschriften und Gesetzen und den Gesetzen,
Vorschriften und dem Recht der Vereinigten Staaten von Amerika haben Recht,
Vorschriften und Gesetze der Vereinigten Staaten von Amerika Priorität. Für diesen
EULA gilt das UN-Kaufrecht (Übereinkommen der Vereinten Nationen über Verträge
beim Internationalen Warenkauf) nicht.
