Perditesimet e Software
Ky produkt është projektuar që të zhvillohet dhe për pasojë, ai
përfiton nga përditësimet e software të siguruara dhe instaluara
automatikisht nga ofruesi juaj i shërbimit. ALBtelecom Sh.A
rezervon të drejtën që të përditësojë automatikisht software-in
në produkt me qëllim përmirësimin e funksionimit te produktit.
Gjatë përditësimeve të software Dekoderi HD ALBtv nuk mund
dhe nuk duhet të fiket derisa software të përditësohet tërësisht.
Herën e parë që ndizet, është e mundur që Dekoderi HD
ALBtv të fillojë menjëherë përditësimin vetë me software-in
operacional të fundit. Është e rëndësishme që gjatë përditësimit
të software Dekoderi HD ALBtv të mos fiket. Përditësimi
i software përfundon pas pak minutash dhe pastaj është i
gatshëm që të gëzoni dobitë e plota të shërbimit të ri ALBtv.

Materialet shoqëruese të produktit
Përdorni vetëm aksesorët e ofruar dhe materialet shoqëruese
të këtij produkti. Përdorimi i aksesorëve ose materialeve
shoqëruese të cilat nuk janë siguruar ose miratuar nga prodhuesi
mund të jenë të pasigurta, ose të dëmshme për jetëgjatësinë
ose performancën e Dekoderit HD ALBtv si dhe do të anulojnë
çdo garanci produkti.
Uji dhe Lagështia
Me qëllim uljen e rrezikut të zjarrit ose shokut elektrik, ky
produkt, aksesorët dhe materialet shoqëruese të tij nuk duhet
të ekspozohen ndaj lëngjeve, shiut ose lagështirës. Produkti nuk
duhet të ekspozohet ndaj pikimit, spërkatjes, dhe lagështirës së
lartë. Mos e përdorni këtë produkt në vendet ku mund të bjerë
në kontakt me ndonjë lëng ose avull.
Kujdesi ndaj Produktit
Shërbimi
Produkti nuk përmban pjesë që kanë nevojë për
mirëmbajtje nga ana e përdoruesit. Produkti nuk
duhet të çmontohet. Përpjekjet për të çmontuar
produktin mund të jenë të pasigurta, ose të dëmshme për
jetëgjatësinë ose performancën e produktit si dhe do të
anulojnë menjëherë çdo garanci të produktit.
Shërbimi duhet të kryhet vetëm nga një person i kualifikuar.
Pastrimi
Mos e spërkatni me ndonjë substancë dhe mos përdorni
produkte pastrimi si shkëlqyes, hollues, ose gërryes, produkte
në formë lëngu, ose aerosol për të pastruar produktin, aksesorët
ose materialet shtesë të tij.

• Pasi të hiqet nga paketimi, aparati duhet të mbahet me kujdes
si dhe nuk duhet të rrëzohet, tundet apo ekspozohet ndaj
ndonjë goditje fizike.
• Shkëputeni aparatin nga rrjeti përpara se të filloni procedurat
e instalimit.
• Aparati është projektuar që të vendoset horizontalisht mbi një
sipërfaqe të sheshtë dhe të fortë.
• Mos e vendosni aparatin aty ku mund të jetë objekt i goditjes
fizike, dridhjeve, ose ku produkti mund të rrëzohet, përmbyset,
rrëshqasë ose tundet pasi kjo mund të shkaktojë lëndime
personale ose dëmtime të pariparueshme të produktit, të cilat
nuk do të mbulohen nga garancia e prodhuesit.
• Mos e vendosni aparatin mbi sipërfaqe të buta si tapete, ose
sende të buta etj. pasi këto sipërfaqe pengojnë qarkullimin e
ajrit, dhe mund t’i shkaktojnë produktit rritje temperature dhe
do të anulojnë garancinë.
• Mos bllokoni hapjet e ventilimeve. Instaloni sipas udhëzimeve
të prodhuesit.
• Mos instaloni rafte dhe mbajtëse në ambientin e instalimit
pa siguruar një minimum prej 100mm (4”) hapësire boshe të
disponueshme në pjesët e përparme, pasme, anësore dhe të
sipërme të produktit.
• Mos e instaloni aparatin pranë ndonjë burimi ngrohje si
radiator, regjistrues ngrohjeje, soba ose aparate të tjera (përfshi
dhe amplifikatorët) të cilët prodhojnë ngrohje, ose ku mund të
ekspozohet direkt ndaj diellit.
• Mos e mbuloni aparatin.
• Mos vendosni pajisje elektronike mbi aparat ose mos e
vendosni aparatin mbi ndonjë sipërfaqe e cila mund të bëhet e
ngrohet nga përdorimi (si amplifikator AV).
• “PARALAJMËRIM” - “Me qëllim uljen e rrezikut të zjarrit ose
shokut elektrik, mos e ekspozoni këtë aparat ndaj shiut ose
lagështirës”.
• Mos e përdorni këtë aparat pranë ujit.
• Mos e ekspozoni aparatin ndaj pikimit dhe spërkatjes; mos
vendosni mbi aparat asnjë objekt të mbushur me lëngje si vazo.
• Mos e merrni ose lëvizni aparatin gjatë kohës që është në
operim. Në rast se produkti duhet të lëvizet, ju lutemi të hiqni
kabllon e sinjalit nga priza e murit dhe të prisni 30 sekonda
përpara se ta lëvizni produktin.
• Aparati nuk është i përshtatshëm për përdorim në ambientet
e jashtme. Kabllot e sinjalit dhe kabllot e energjisë duhet të
kalojnë andej ku nuk shkelen, nxehen nga fërkimi, pengohen
ose shtypen nga sendet e vendosura sipër ose kundrejt tyre.
Kabllot elektrike nuk duhet të kalojnë poshtë tapeteve ose
qilimave ku nuk mund të vihet re dëmtimi.
• Mbroni kabllon e energjisë nga shkeljet ose nga shtypjet tek
priza dhe pikën ku ato dalin nga aparati.
• Aparati duhet të operojë vetëm nëpërmjet llojit të furnizuesit
me energji të siguruar nga prodhuesi dhe sipas indikacionit të
shënuar në etiketë. Kablloja kryesore e energjisë përshtatet
me një prizë që është projektuar për përdorimin me burimin e
energjisë të vendit të instalimit. Në rast se nuk jeni të sigurtë për
energjinë që furnizohet shtëpia juaj, atëherë konsultohuni me
kompaninë lokale të energjisë elektrike.
• Foleja-dalëse duhet të instalohet pranë pajisjes ku të jetë
lehtësisht e aksesueshme.
• Mos e anashkalo masën e sigurisë me anë të prizës së tokëzimit
Një prizë e polarizuar ka dy fisha ku njëra është më e gjerë se
tjetra. Priza e tokëzimit ka dy fisha dhe një të tretë tokëzimi.
Fisha e gjerë ose fisha e tretë është për sigurinë. Në rast se priza
e siguruar nuk përshtatet me prizën tuaj, atëherë keshillohuni
me një elektricist për zëvendësimin e prizës së vjetër.
• Përdor vetëm shtesat dhe aksesorët e specifikuar nga
prodhuesi.
• Të gjitha shërbimet duhet t’i referohen personelit të kualifikuar
të shërbimit. Shërbimi kërkohet në rastet kur aparati është
dëmtuar, si dëmtimi i prizës ose kabllos së energjisë elektrike,
të jetë derdhur lëng ose të kenë rënë objekte mbi aparat,
aparati të jetë ekspozuar ndaj shiut dhe lagështirës, nuk operon
normalisht, ose të jetë rrëzuar.
• Burime flake si qirinjtë, nuk duhet të vendosen mbi aparat.
• Stako aparatin nga priza e murit përpara se ta pastroni atë.
Përdorimi
Aparati dhe furnizuesi i energjisë do të ngrohet gjatë përdorimit.
Në rast se aparati, furnizuesi i energjisë dhe materialet
shoqëruese të produktit nxehen, hiqni menjëherë fishën
nga furnizuesi i energjisë elektrike si dhe njoftoni ofruesin e
shërbimit për ta rregulluar.
Mbrojtja nga rrufetë dhe Heqja nga përdorimi.
Në rastet e motit te paqëndrueshëm me pritshmëri rrufesh, ose
nëse produkti nuk do të përdoret për një afat të gjatë, ju lutem
hiqni kabllon e energjisë nga priza e murit, stakoni lidhjen e
rrjetin të IPTV nga pjesa e pasme e produktit dhe hiqni fishën e
videos dhe RF nga televizori.
Përdorimi me monitor plazme
Kur të përdorni aparatin me disa tipe televizorësh plazma, është
e rëndësishme që te mos ndaloni figurën (pause) për një kohë
të gjatë (më shumë se 5 minuta) pasi imazhi i ndaluar mund të
mbetet përgjithmonë në ekranin e televizorit tuaj duke e bërë
atë të papërdorshëm. Ky defekt nuk është defekt i aparatit, por
kufizim i teknologjisë së televizorëve plazma. ALBtelecom Sh.A
nuk është përgjegjëse për dëmtime të tilla.

LICENCA E SOFTWARE-it
Marrëveshja për Licencën e Software-it
E rëndësishme – ju lutemi ta lexoni me kujdes:
Duke përdorur software-in në Amino A 139 tuaj (“Produkti”), ju
(“Ju”) bini dakord të përmbushni kushtet e kësaj Marrëveshje
për Licencë Software (“Marrëveshja”). Nëse nuk bini dakord
të përmbushni kushtet e kësaj Marrëveshje, ju duhet të
ndërprisni menjëherë të gjitha përdorimet e Produktit dhe të
ktheni produktin dhe të gjitha pjesët e tij në paketimin origjinal
te ofruesi juaj i shërbimit ose te ofruesi nga i cili keni marrë
Produktin.
Dhënia e Licencës, Kufizimet
Referuar kushteve të kësaj Marrëveshje, Amino Communications
Ltd dhe partnerët e saj (bashkarisht referuar si “Amino”) ju
lëshojnë një licencë jo-ekskluzive, të pa-trasferueshme, pa
pasur të drejtën për të nën-licencuar; ju mund ta përdorni
software-in e përfshirë në Produkt ose që iu është ofruar ju, dhe
dokumentacionin përkatës vetëm për përdorimin tuaj jo-tregtar
dhe vetëm në lidhje me përdorimin e Produktit. Ju jeni bërëi me
dije dhe bini dakord se Amino dhe ofruesi juaj i shërbimit mund
të përditësojnë, modifikojnë dhe të përmirësojnë vazhdimisht
software-in e Produktit. Ju bini dakord se: a) nuk do të përpiqeni
të modifikoni, përmirësoni, çmontoni, shpërbëni, zbuloni
teknologjinë; ose të përpiqeni të keni akses në kodin e burimit
të software-it; dhe b) nuk do të përpiqeni të hiqni ose shkëpusni
software-in nga Produkti. Çdo rishitje ose transferim i Produktit
do t’i nënshtrohet afateve dhe kushteve të kësaj marrëveshjeje.
Materialet e Regjistruara
Amino A139 është projektuar për marrjen e figurës dhe
sinjalit zanor të TV-së (“Materialeve”) për përdorim personal
në përputhje me legjislacionin në fuqi, marrëveshjet për
licencën ose marrëveshjet e shërbimit, prej të cilave ju keni
pasur akses për këto Materiale. Çdo përdorim tjetër është
shprehimisht i ndaluar. Është përgjegjësia juaj të veproni në
përputhje me legjislacionin dhe të pranoni të përmbushni,
respektoni legjislacionin dhe marrëveshjet në fuqi. Regjistrimet
e paautorizuara të materialeve që kanë të drejta autori, ose
sigurimi i kopjeve të këtyre materialeve te të tjerët mund të
shkelintë drejtat e zotëruesve, të drejtat e autorit dhe mund të
përbëjnë gjithashtu vepra penale në disa juridiksione. Për disa
performanca të caktuara publike dhe disa përdorime tregtare
të caktuara duhet të merret paraprakisht leja nga zotëruesit
e të drejtave të autorit. Ju pranoni të dëmshpërbleni dhe të
mos cënoni Aminon dhe të licencuarit e sa nga ndonjë shkelje
e kufizimeve të të drejtave të autorit në fuqi në lidhje me
përdorimin tuaj të Produktit. Ofruesi juaj i shërbimit mund t`iu
këshillojë për përdorimin e ligjshëm të Produktit.
Pronësia
Amino dhe të licensuarit e saj zotërojnë dhe mbajnë të gjitha
të drejtat e pronësisë, përfshirë të gjitha patentat, të drejtat e
autorit, sekretet tregtare, markat tregtare dhe të drejtat e tjera
të pronësisë intelektuale në dhe për software-in dhe të çdo
përmirësimi ose modifikimi të software-it që do t`iu ofrohet.
Ju pranoni se licenca e dhënë sipas kësaj marrëveshje nuk iu
jep titullin ose pronësinë e software-it, por vetëm të drejtën
për një përdorim të kufizuar sipas afateve dhe kushteve të kësaj
kontrate.
Garancitë e Software-it
Deri në masën maksimale të lejuar nga ligji në fuqi, Amino
prezanton produktin pa asnjë premtim garancie apo pohim
për gjëndjen e mallit si dhe refuzon të njohë çdo dhe të gjitha
garancitë e software-it, të shprehura ose të nënkuptuara,
përfshirë por pa u kufizuar në ndonjë garanci të nënkuptuar
tregtie, përshtatje me qëllimin, nuk do të shkelë të drejtat
e palëve të treta dhe ato që lindin nga një marrëveshje ose
përdorimi i tregtisë. Nuk do të jepet asnjë përfaqësim ose
garanci që të parashikojë se përdorimi i software-it do të jetë pa
defekte, pa gabime ose i pandërprerë, dhe defektet ose gabimet
do të riparohen ose funksionaliteti i software-it do të përmbushë
kërkesat tuaja.
Kufizimi i Detyrimeve
Per sa lejohet nga legjislacioni në fuqi, Amino, furnitorët dhe
licencuesit përkatës nuk do të jenë përgjegjës për humbjen e
fitimeve, ndërprerjen e biznesit, humbjen e informacionit ose të
dhënave, ose humbje të tjera në fitime, ose për dëme të tjera të
rrjedhura, të tërthorta, të rastësishme, speciale, ndëshkuese ose
dëme të tjera që rrjedhin nga kjo marrëveshje; për përdorimin
ose pamundësinë për të përdorur software-in, edhe në qoftë
se Amino, furnitorët e saj ose licensuesit janë informuar mbi
mundësinë e dëmeve të tilla.
Përfundimi
Kjo marrëveshje dhe licencat që janë lëshuar sipas kësaj
marrëveshje do të përfundojnë menjëherë nëse ju nuk arrini
të respektoni kufizimet e licencës të parashikuara në këtë
marrëveshje. Asnjë njoftim paraprak nuk i kërkohet Amino-s për
përfundimin si më sipër. Në përfundim të marrëveshjes ju duhet
të ktheni të gjitha hardware-t, software-t, dokumentacionet e
produktit dhe aksesorët te ofruesi i shërbimit ose furnitori prej
të cilit keni marrë Produktin.
Kontrollet e Eksportit
Ju pranoni dhe bini dakord se asnjë nga software-t ose
informacioni kyç, ose ndonjë teknologji nuk mund të
shkarkohet ose të eksportohet ose të ri-eksportohet: a) në
(ose te një shtetas ose rezident i) Angola, Kubë, Iran, Irak, Libi,
Korenë e Veriut, Sudan, Siri, ose ndonjë shtet tjetër, të cilit SHBA
i ka vënë embargo për mallrat; ose te ndonjë nga te renditurit
ne listat e Departamentit të Thesarit të SHBA-së të Kombësive
te përcaktuara specifikisht ose të listës së kompanive dhe
individëve të cilëve ju ndalohet eksporti i mallrave nga SHBA të
Departamentit të Tregtisë së SHBA-së. Duke përdorur software-
in, ju përfaqësoni dhe garantoni se nuk jeni rezident ose shtetas i
ndonjërit prej këtyre vendeve ose në ndonjë nga listat.
Përdoruesit e Qeverisë së SHBA-së
Ky software është një produkt tregtar dhe ofrohet me të
drejta të kufizuara. Përdorimi, riprodhimi, lëshimi, modifikimi
ose nxjerrja e software-it ose ndonjë pjese të saj, përfshirë të
dhënat teknike është i kufizuar sipas Rregullores Federale të
Përvetësimit (FAR) 21.212 për agjencitë civile dhe Përvetësimin
Federal të Mbrojtjes (DFARS) 227.7202 për agjencitë ushtarake.
Legjislacioni
Nëse e keni marrë këtë produkt në Shtetet e Bashkuara,
kjo kontratë do të rregullohet nga legjislacioni i Shtetit të
Georgia (Xhorxhias) pa iu referuar parimeve ose konflikteve të
legjislacionit. Ju bini dakord se të gjitha mosmarrëveshjet që do
të lindin nga kjo marrëveshje do t’i nënshtrohen ekskluzivisht
juridiksionit dhe vendit në gjykatat federale dhe shtetërore të
Atlantës, Xhorxhias, dhe ju nëpërmjet kësaj marrëveshje jepni

Software Updates
This product is designed to evolve and as a consequence,
it benefits from software updates provided and installed
automatically by your service provider. ALBtelecom Sh.A
reserves the right to automatically update the software on the
product in order to improve the product functionality.
During software updates, the ALBtv HD Decoder cannot be
used and
must not be switched off until the software update is complete.
The first time it is powered, it is possible that the ALBtv
HD Decoder will immediately start updating itself with the
latest operating software. While the software is updating it is
important that the ALBtv HD Decoder is not switched off. The
software update will be complete after a few minutes and you
will then be ready to enjoy the full benefits of your new digital
TV service.

• Once removed from the transit packaging, the apparatus
must be handled with care and must not be dropped, shaken or
exposed to any physical shock.
• Disconnect the apparatus from the mains before you start any
installation procedures.
• The apparatus is designed to be placed horizontally on a hard
flat surface.
• Do not place the apparatus where it may be subject to physical
shock or vibration or where the product may drop, topple, slide
or shake as this may cause personal injury or irreparable damage
to the product, which will not be covered by the manufacturer’s
warranty.
• Do not stand the apparatus on a soft surface such as carpets or
soft furnishings etc as these surfaces will obstruct airflow, may
cause the product to overheat and will invalidate the warranty.
• Do not block any ventilation openings. Install in accordance
with the manufacturer’s instructions.
• Do not install the apparatus into any built-in installation such as
a bookcase or rack without ensuring that a minimum of 100mm
(4”) of clear space is available at the front, rear, sides and top of
the product.
• Do not install the apparatus near any heat sources such as
radiators, heat registers, stoves, or other apparatus (including
amplifiers) that produce heat, or where it may be exposed to
direct sunlight.
• Do not cover the apparatus.
• Do not stack electronic equipment on the top of the apparatus
or place on top of any surface that may become warm in use
(such as an AV amplifier).
• “WARNING” - To reduce the risk of fire or electric shock, do
not expose this apparatus to rain or moisture.
• Do not use this apparatus near water.
• Do not expose the apparatus to dripping or splashing; no
objects filled with liquids such as vases should be placed on the
apparatus.
• Do not pick up or move the apparatus whilst it is operating. If
the product must be moved, please unplug the lead from the
wall socket and wait 30 seconds before moving the product.
• The apparatus is not suitable for outdoor use. The leads and
power-supply cord must be routed where they cannot be
walked on, chafed, tripped over or pinched by items being
placed on or against them. Power-supply cords must not be
routed underneath carpets or rugs where any damage could
not be seen.
• Protect the power cord from being walked on or pinched,
particularly at plugs, convenience receptacles, and the point
where they exit from the apparatus.
• Operate the apparatus only from the type of power supply
supplied by the manufacturer and as indicated on the marking
label. The mains lead is fitted with a plug that is designed for use
with the power source of the country of installation.If you are
not sure of the power supplied to your home, consult your local
power company.
• The socket-outlet shall be installed near the equipment and
shall be easily accessible.
• Do not defeat the safety purpose of the polarised or
grounding-type plug. A polarised plug has two blades with one
wider than the other. A grounding type plug has two blades
and a third grounding prong. The wide blade or the third prong
are provided for your safety. If the provided plug does not fit
into your outlet, consult an electrician for replacement of the
obsolete outlet.
• Only use attachments and accessories specified by the
manufacturer.
• Refer all servicing to qualified service personnel.Servicing is
required when the apparatus has been damaged in any way,
such as the power-supply cord or plug is damaged, liquid has
been spilled or objects have fallen into the apparatus, the
apparatus has been exposed to rain or moisture, does not
operate normally, or has been dropped.
• No naked flame sources, such as light candles, should be
placed on the apparatus.
• Disconnect the apparatus from the wall outlet before cleaning.
Operation
The apparatus and power-supply will get warm to the touch
when in use. If the apparatus,power-supply or attachments
become hot to the touch, immediately unplug the apparatus
from the mains electricity supply and call your service provider
to arrange replacement.
Lightning Protection and Not in Use
If lightning is expected, or the product is not going to be used
for a long period of time, please unplug the mains lead from
the wall outlet, unplug the digital TV network connection from
the rear of the product and unplug the video and RF leads to
the television.
Use with Plasma Displays
When used with certain display types, such as plasma displays,
it is important that the picture is not paused for a long time
(greater than 5 minutes) as the image displayed may then be
‘burned’ permanently into the screen of the display device.
This effect is not a defect of the apparatus but a limitation of
the display device. Amino Communications Ltd. will not be held
liable for damage so caused.

SOFTWARE LICENSE
Software License Agreement
IMPORTANT - PLEASE READ THIS CAREFULLY:
By using the software in your Amino A139 (“Product”), you
(“You”) agree to be bound by the terms of this Software License
Agreement (“Agreement”). If you do not agree to be bound by
the terms of this Agreement, you must immediately cease all use
of the Product and return the Product and all accessories, in the
original packaging to your service provider, or the supplier from
which you obtained the Product.
License Grant; Restrictions
Subject to the terms of this agreement, Amino Communications
Ltd and its affiliates (collectively “Amino”) grants you a non-
exclusive, non-transferable license, without the right to
sub-license, to use the software included with the Product or
subsequently provided to you, and its associated documentation
solely for your non-Commercial use and solely in connection
with your use of the Product. You acknowledge and agree that
Amino and your service provider may periodically update,
modify or enhance the Product software. You agree that;
a) you will not attempt to modify, enhance, disassemble,
decompile, reverse engineer or otherwise attempt to gain
access to the source code to the software; and
b) you will not attempt to remove or unbundle the software
from the Product. Any resale or transfer of the Product by you
will be subject to the terms and conditions of this agreement.
Recorded Materials
The Amino A139 is intended for the reception of TV picture and
sound signals (“Materials”) for personal use in conformance with
applicable laws, license agreements or service agreements
under which you have obtained access to such Materials. Any
other use is expressly prohibited. It is Your responsibility to
comply with, and you agree to be bound by, all such applicable
laws and agreements.
Unauthorized recording of copyrighted material, or providing
copies of such material to others, may infringe the rights of
copyright owners and may also be a criminal offence in some
jurisdictions.
Prior permission from the copyright owners may be required for
certain public performances and certain commercial uses. You
agree to indemnify and hold harmless Amino and its Licensors
against any breach by You of applicable copyright restrictions in
connection with your use of the Product. Your service provider
can advise you on the legitimate use of the Product.
Ownership
Amino and its licensors own and retain all proprietary rights,
including all patent, copyright, trade secret, trademark and
other intellectual property rights in and to the software and
to any enhancements or modifications to the software which
may be provided to you. You acknowledge that the license
granted under this agreement does not provide you with title
or ownership to the software but only to a right of limited use
under the terms and conditions of this agreement.
Software Warranties
To the maximum extent permitted by applicable law, Amino
makes no representations and disclaims any and all warranties,
express or implied with respect to the software, including,
without limitation, any implied warranty of merchantability,
fitness for purpose, non-infringement of third party rights
and those arising from a course of dealing or usage of trade.
No representation is made or warranty is given that use of the
software will be defect free or error free or uninterrupted, that
any defects or errors will be corrected or that the functionality
of the software will meet your requirements.
Limitation of Liability
To the maximum extent permitted by applicable law, Amino,
its suppliers and licensors will not be liable for loss of profits,
business interruption, loss of information or data, or other
pecuniary loss, or for any consequential, indirect, incidental,
special, punitive or other damages whatsoever arising out of
this agreement or the use or inability to use the software, even
if Amino or its suppliers or licensors have been advised of the
possibility of such damages.
Termination
This agreement and the licenses granted hereunder shall
immediately terminate if you fail to comply with the license
limitations described in this agreement. No notice will be
required from Amino to effect such termination. On termination
of this agreement you must return all hardware, software and
product documentation and accessories to the service provider,
or the supplier from which you obtained the Product.
Export Controls
You acknowledge and agree that none of the software or
underlying information or technology may be downloaded or
otherwise exported or re-exported: a) into (or to a national or
resident of) Angola, Cuba, Iran, Iraq, Libya, North Korea, Sudan,
Syria, or any other country to which the US has embargoed
goods; or any one on the US Treasury Department’s list
of Specially Designated Nationals or the US Commerce
Department’s Table of Denial Orders. By using the software, you
represent and warrant that you are not a resident or national of
any such country or on any such list.
US Government Users
This software is a commercial product and is provided with
restricted rights. Use, reproduction, release, modification or
disclosure of the software or any part thereof including technical
data is restricted in accordance with Federal Acquisition
Regulation (FAR) 21.212 for civilian agencies and Defense Federal
Acquisition (DFARS) 227.7202 for military agencies.
Law
If you acquired this Product in the United States, this agreement
shall, in all respects, be governed by the laws of the State of
Georgia without reference to its principles or conflicts of laws.
You hereby agree that all disputes arising out of this agreement
shall be subject to the exclusive jurisdiction and of and venue
in the federal and state courts within Atlanta, Georgia, and
you hereby consent to the personal and exclusive jurisdiction
and venue of these courts. If you acquired this product in the
United Kingdom, the laws of England shall apply, and you hereby
consent to the exclusive jurisdiction and venue of these courts.
If you acquired this product elsewhere, then local law may apply.
Miscellaneous
If any of the provisions of this agreement are held to be invalid
under any applicable statute or rule of law, they are, to that
extent, deemed omitted. Any delay by Amino in exercising any
of its rights shall not constitute a waiver of any such right. This
agreement constitutes the complete and exclusive agreement
between you and Amino with respect of the subject matter
hereof and supersedes all prior oral or written understandings,
communications or agreements. This agreement may not be
modified except in writing by a duly authorized representative of
Amino. All headings are for convenience and shall have no effect
on interpretation of this Agreement.
