LIMITEDWARRANTY
PacificMicroSystemswarrantsitsproductstobefreefromdefectsinmaterialsand
workmanshipforaperiodofone yearfromdateofsaletotheoriginalowneror
fifteenmonthsfromdateofsalefromPacificMicroSystems.
Thiswarrantyprovidesfortherepairorreplacement(atouroption)ofanyparts
foundtobedefectiveinnormalandintendeduse,providedthatsuchdefectsarein
ouropinionduetofaultymaterialorworkmanship.
Thiswarrantydoesnotapplytoproductswhichhavebeenimproperlyinstalled,
subjectedtoextremesbeyondthelimitsofourspecifications,orwhichhavebeen
physicallydamaged.Nordoesitapplytoproductsfoundtobedefectivedueto
abuse,lightningoranyotherelectricaldischarge,saltorfreshwater,spray,or
improperorunauthorisedrepair.PacificMicroSystemswillpayshipping(method
tobeofourchoice)andinsurance forreturnofsaidproductprovidedthatthe
returnedproductproveddefectiveunderthetermsandconditionsofthiswarranty.
TheobligationofPacificMicroSystemsshallbelimitedtotherepairor
replacementonly.
InnoeventshallPacificMicroSystemsbeliableforanyspecial,collateral,
incidentalorconsequentialdamagesfor(1)breachofanyprovisionshereof,
including,withoutlimitation,provisionsregardingwarranties,guarantees,and/or
indemnities:or(2)anyclaimsbythepurchaserconcerningthegoodswithout
limitation,claimsoflossofgoodwill,lossofprofitorrevenues,lossofuse,costof
removal,installationorreinstallation,personalinjuryofanykindtothepurchaser
oranyoneelse.
Theforgoingwarrantyisinlieuofallotherwarranties,whetherexpressedor
implied,orarisingbylaw,custom,orconduct,including,withoutlimitation,
thewarrantiesofmerchantabilityand/orfitnessforanyparticularpurpose.
