EN – DIRECTIONS & SAFETY INFORMATION
INDICATIONS FOR USE
The Ava Fertility Tracker is intended to monitor a woman’s ferti-
lity by measuring and recording physiological parameters (body
temperature, resting pulse rate, heart rate variability, and bre-
athing rate) as an aid in ovulation prediction to aid in conception
(not to be used for contraception).
INTENDED USE
The Ava Fertility Tracker is a non-invasive device intended to
measure and display physiological parameters to aid women in
ovulation prediction to facilitate conception. Additionally, para-
meters are collected to improve the quality of the prediction,
and to provide general information on health and wellness.
Temperature is the most important measurement in support of
the Ava Fertility Tracker’s prediction of the fertile window. This,
in combination with historical menstrual cycle data, is the basis
for the Fertility Tracker technology and the intended use of the
device. The Ava device (bracelet) is combined with smartphone
applications to display the physiological parameters and to
gather user inputs.
CONTRAINDICATIONS
Ava is not a contraceptive and cannot be used to prevent pregnancy.
Not for cycles outside of 24 – 35 days range.
Not for women with infertility issues.
PRECAUTIONS & WARNINGS
Not for pacemaker wearers; sensors of this device may interfere
with pacemakers. Consult your doctor prior to use.
Do not use if you suffer from cholinergic urticaria (sweat in-
duced allergies).
If you have tendonitis, carpal tunnel syndrome, or other muscu-
loskeletal disorders, consult your doctor prior to use.
Keep this product away from other high frequency devices
which may interfere with operation.
The Ava device is not to be used for fever measurement and to
diagnose, treat, cure, or prevent any disease.
Please carefully read the instructions for use prior to wearing
the device.
HANDLING, OPERATION & STORAGE
The Ava device is splash proof but not waterproof. It should not
be worn while showering or in water. Do not operate in environ-
ment with more than 80% relative humidity.
Do not use the Ava device in a sauna or steam room. The maxi-
mum ambient temperature for operation is 38°C / 100°F.
Do not use the Ava device under influence of low atmospheric
pressure.
Do not operate when pressure is below 740 mbar.
Use skin care products sparingly on the areas of your skin co-
vered by the Ava device.
Do not wear your device while charging it.
Do not charge your device while it is wet.
Do not use a damaged USB cable to charge your device.
Only charge your device using a computer, powered hub or po-
wer supply that is certified by a recognized testing laboratory.
Do not drop, knock, or shake the device. Rough handling and
vibration can damage internal circuit boards and sensitive me-
chanical components.
The use and standby times are approximate, and may be af-
fected by device settings, battery condition, temperature and
other factors.
Do not apply mechanical stress.
Do not open the enclosure or disassemble the device.
Do not attempt to remove the battery from the device.
Substances in this product and its battery may harm the en-
vironment or cause injury if handled and disposed improperly.
Do not dispose the device in a fire. The battery could explode.
Do not store or transport the device in hot conditions (above
35°C / 95°F) or cold conditions (below 5°C / 41°F).
Do not store or transport the device in moist conditions (no
more than 80% relative humidity)
Do not store or transport the device under influence of low
atmospheric pressure (not lower than 740 mbar).
Do not use harsh chemicals, cleaning solvents or powerful de-
tergents to clean the device. Use a clean, damp cloth. Do not
wash the Ava device undera faucet.
Avoid static electricity, ESD and high voltage as these may da-
mage the product.
Do not expose the product to the following conditions:
Corrosive gasses such as Cl2, H2S, NH3, SO2, or NOx
Extreme humidity or salty air.
Prolonged exposure to direct sunlight.
Temperatures beyond those specified for operation.
This package contains small parts that may be hazardous to
children and should be kept out of reach of small children. This
product is not a toy. Do not allow children or pets to play with
the device.

ADVERSE EVENTS
The device uses biocompatible materials. Wearing the device
snugly for extended time can lead to skin irritation due to rub-
bing and friction. Wear the device only during the night to allow
your skin to dry and breathe during the day.
Remove your device if it feels hot.
If you feel soreness, tingling, numbness, burning or stiffness in
your hands or wrists while or after wearing the product, please
discontinue use.
AVA LIMITED PRODUCT WARRANTY
This Limited Warranty Policy (“Warranty”) is offered by Ava AG,
a company formed under the laws of Switzerland with domicile
in Zurich, Switzerland, and its subsidiary Ava Science, Inc., a
Delaware corporation with principal business in San Francisco,
California (collectively „Ava“ or „we“). The Warranty applies to
the sale and use of Ava-branded fertility tracking bracelet mar-
ked with the “Ava” trade name or logo and containing a valid
Ava serial number which were sold/purchased on Ava’s website
(“Site”) or from an authorized reseller (“Product”).
This Warranty is also governed by the most current version of
the Terms of Service (“Terms”), which are located at www.ava-
women.com/terms-of-service and are hereby incorporated into
this Warranty by reference as though set forth in full herein.
In case of a conflict between the Terms and the Warranty, the
Terms shall prevail.
BY USING YOUR PRODUCT, YOU ARE AGREEING TO BE BOUND BY
THE TERMS OF THIS WARRANTY. DO NOT USE YOUR PRODUCT
UNTIL YOU HAVE READ THE TERMS OF THE WARRANTY. IF YOU
DO NOT AGREE TO THE TERMS OF THE WARRANTY, DO NOT USE
THE PRODUCT.
1. Scope of Warranty.
This Warranty applies only to the original purchaser (“you”) who
purchased the Product from an authorized source.
This Warranty gives you specific legal rights, and you may have
other legal rights, including under consumer laws, that vary
in different jurisdictions. To the extent permitted by law, this
Warranty and the remedies set forth are exclusive and in lieu
of all other warranties, remedies and conditions, whether oral,
written, statutory, express or implied. Ava disclaims all statutory
and implied warranties, including without limitation, warranties
of merchantability and fitness for a specific purpose and war-
ranties against hidden or latent defects, to the extent permit-
ted by law. In so far as such warranties cannot be disclaimed,
Ava limits the duration and remedies of such warranties to the
duration of the Warranty (to the extent permitted by law) and,
at Ava’s option, the repair or replacement services described
below. Some jurisdictions do not allow limitations on how long
an implied warranty (or condition) may last, so the limitation
described above may not apply to you.
2. Product Warranty.
Ava warrants that the Product will be free from material defects
in workmanship and materials under normal use for a period
of one (1) year from the date of your purchase, unless longer
minimum periods are required under mandatory laws in your
jurisdiction (“Warranty Period”).
3. Remedies.
If you submit warranty claims to Ava before the end of the War-
ranty Period and your Product clearly and verifiably fails the
warranty, Ava will, in its sole discretion: (i) refund you in the
amount of the price you paid for the Product (excluding taxes
and shipping costs); (ii) exchange the Product with a new or
refurbished Product (exchange the Product of identical specifi-
cations or functional equivalent); or (iii) repair the Product. This
Section sets forth your sole and exclusive remedy, to the extent
permitted by law. Returns shipped without Ava’s prior express
return authorization will not be accepted.
If a Product has been exchanged or repaired following this War-
ranty, it will be subject to a warranty for either: (i) the remaining
original Warranty Period; or (ii) thirty (30) days from the date of
repair or replacement or for any additional period that is ap-
plicable in your jurisdiction. This Warranty does not cover the
software embedded in the Product and the services provided by
Ava to owners of the Product, nor your use of the Site and the
application provided by Ava. Please refer to the Terms for details
of your rights with respect to their use.
4. Obtaining Warranty Service.
You must deliver the Product to the address specified by Ava in
either its original packaging or packaging providing an equal de-
gree of protection. In accordance with applicable law, Ava may
require that you furnish proof of purchase details and/or comply
with registration requirements before any warranty service is
rendered. It is your responsibility to synchronize any data stored
on the Product. It is likely that such data will be lost or refor-
matted during service, and Ava will not be responsible for any
such damage or loss. Ava is not responsible for lost or damaged
return shipments. You assume responsibility for the payment of
any shipping charges and for all risk of loss or damage to the
Product during shipment to Ava.
5. Exclusions and Limitations.
This Warranty does not apply to, and explicitly excludes, the
following: (a) consumable parts, such as straps, unless damage
has occurred due to a defect in materials or workmanship in the
Product; (b) normal wear and tear and cosmetic damage, inclu-
ding, but not limited to, scratches, dents, damaged packaging
material or damaged plastic parts; (c) defects or damage cau-
sed by alteration, unusual stress, accident (including, without
limitation, collision, modification fire and the spillage of food or

liquid), neglect, abuse, misuse, unauthorized repair, installation,
wiring, improper storage or testing, use of third party accesso-
ries such as straps or cables, third-party applications downloa-
ded to the Product or if the serial number has been removed;
(d) damage caused by using the Product outside the permitted
or intended uses described by Ava; (e) damage caused by use
with non-Ava products; (f) any non-Ava hardware products or
any software, even if packaged or sold with the Product; and
(g) modifications of the Product by anyone other than Ava. Ava
reserves the right to disable Product if Ava suspects fraud or if
Ava finds out that the Product is counterfeit, stolen or lost in
shipment. This Warranty does not cover software embedded in
the Product and the services provided by Ava to owners of the
Product. Please refer to the Terms for details of your rights with
respect to their use.
6. Implied Warranties.
EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE MAN-
DATORY LAW, ALL IMPLIED WARRANTIES (INCLUDING WAR-
RANTIES OF MERCHANTABILITY AND FITNESS FOR A SPECIFIC
PURPOSE) SHALL BE EXCLUDED OR, IF LEGALLY NOT PERMIT-
TED, LIMITED IN DURATION TO THE DURATION OF THIS LIMITED
WARRANTY.
Some jurisdictions do not allow limitations on the duration of an
implied warranty, so the above limitation may not apply to you.
7. Limitation of Damages.
AVA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL,
SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES WHETHER
ARISING IN AN ACTION (INCLUDING WITHOUT LIMITATION LOSS
OF REVENUE, USE, PROFITS, DATA, OR GOODWILL OR COSTS
OF PROCURING SUBSTITUTE PRODUCTS) FOR BREACH OF CON-
TRACT, TORT, PRODUCT LIABILITY OR ANY OTHER CAUSE OR
THEORY OF LIABILITY, RELATED TO OR IN CONNECTION WITH
THIS WARRANTY, THE TERMS OR THE PURCHASE, SALE, USE,
OPERATION OR PERFORMANCE OF THE PRODUCTS. AVA AND
YOU HAVE AGREED THAT THESE LIMITATIONS WILL SURVIVE
AND APPLY EVEN IF ANY LIMITED REMEDY SPECIFIED IN THESE
TERMS IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPO-
SE. YOU AGREE AND ACKNOWLEDGE THAT THE TOTAL AMOUNT
OF AVA’S LIABILITY, IF ANY, FOR ANY AND ALL CLAIMS, CAUSES
OF ACTION, LOSSES, DAMAGES, OR JUDGMENTS ARISING OUT
OF OR RELATED TO THIS AGREEMENT OR THE SERVICES SHALL
NOT EXCEED THE COST OF THE PRODUCT AT ISSUE OR $500.00,
WHICHEVER IS GREATER.
Some jurisdictions do not allow the limitation or exclusion of
liability for incidental or consequential damages, so the above
limitation or exclusion may not apply to you.

Der Ava Fruchtbarkeitstracker dient zur Überwachung der
fruchtbaren Tage einer Frau durch Messung und Aufzeichnung
der physiologischen Parameter (Körpertemperatur, Ruhepuls-

mittel, um die Ovulation vorherzusagen zur Unterstützung der

VERWENDUNGSZWECK
Der Ava-Fruchtbarkeitstracker ist ein nicht-invasives Gerät, das
dazu gedacht ist, die physiologischen Parameter zu messen und
anzuzeigen, um Frauen bei der Vorhersage ihres Eisprungs zu
unterstützen und ihnen dadurch die Empfängnis zu erleichtern.
Zusätzlich werden Parameter erfasst, um die Qualität der Vor-
hersage zu verbessern und allgemeine Informationen zum Ge-
sundheitszustand und Wohlbefinden bereitzustellen.
Die Körpertemperatur ist die wichtigste Messgröße zur Unter-
stützung der Voraussage des fruchtbaren Fensters durch den
Ava-Fruchtbarkeitstracker In Kombination mit den Daten von
früheren Menstruationszyklen stellt dies die Grundlage für die

HANDHABUNG, BETRIEB & LAGERUNG
Das Ava Armband ist spritzwasserfest, aber nicht komplett
wasserdicht. Das Armband vor dem Duschen oder im Wasser
abnehmen. Nicht in einer
Umgebung mit mehr als 80 % relativer Luftfeuchtigkeit ver-
wenden.
Verwenden Sie das Ava Armband nicht in der Sauna oder im
Dampfbad. Die Höchsttemperatur für den Betrieb ist 38°C /
100°F
Das Ava Gerät nicht unter dem Einfluss von niedrigem atmo-
sphärischem Druck verwenden. Nicht verwenden, wenn der
Druck unter 740 mbar sinkt.
Tragen Sie nur geringe Mengen an Hautpflegeprodukten auf die
Stelle auf, an der Sie das Ava Armband tragen.
Tragen Sie das Armband nicht während des Ladevorgangs.
Das Gerät nur im trockenen Zustand laden.
Zum Laden kein defektes USB-Kabel verwenden.

NEBENWIRKUNGEN
Das Armband besteht aus biokompatiblen Materialien und sollte
deshalb keine Allergien hervorrufen. Durch den engen Hautkon-
takt beim Tragen
kann es jedoch durch die Reibung zu Hautirritationen kommen.
Tragen Sie das Armband deshalb nur nachts, damit sich Ihre
Haut tagsüber erholen kann.
Wenn Sie während des Tragens oder nach Abnehmen des
Armbands ein Wundgefühl, Kribbeln, Taubheit, Brennen oder
Steifheit an den Händen oder Handgelenken verspüren, dann
verwenden Sie das Armband nicht mehr.
BESCHRÄNKTE GEWÄHRLEISTUNG VON AVA
Die Ava AG bietet Ihnen eine beschränkte Gewährleistung („Ga-
rantie“). Die Ava AG (nachfolgend „Ava“ bzw. „wir“ genannt) ist
eine Gesellschaft nach Schweizer Recht mit Sitz in Zürich. Eine
weitere Niederlassung mit der Bezeichnung Ava Science, Inc.
hat ihren Hauptgeschäftssitz im kalifornischen San Francisco.
Die Gewährleistung gilt für den Verkauf und die Verwendung
von Ava-Armbändern, die mit dem Handelsnamen oder Logo
„Ava“ gekennzeichnet sind, über eine gültige Ava Seriennummer
verfügen und online auf der Ava Webseite oder von einem auto-
risierten Fachhändler gekauft wurden.

1. Umfang der Gewährleistung
Der Gewährleistungsanspruch gilt nur für Erstkäufer („Sie“), die
das Produkt von einem autorisierten Händler erworben haben.
Die Gewährleistungsbestimmungen verleihen Ihnen spezifische
Rechte, zusätzlich zu Ihren Rechten als Verbraucher, die sich je
nach der Rechtsprechung Ihres Landes unterscheiden können.
Soweit gesetzlich zulässig, gelten diese Gewährleistungsbe-
stimmungen und festgelegten Rechtsmittel ausschliesslich und
an Stelle von allen anderen Garantiebedingungen, Rechtsmit-
teln oder Bedingungen, unabhängig davon ob diese mündlich,
schriftlich, gesetzlich, explizit oder implizit festgelegt wurden.
Ava schliesst jede Art von gesetzlicher und impliziter Gewähr-
leistung aus, einschliesslich der Zusicherung der allgemeinen
Gebrauchstauglichkeit oder der Gewährleistung der Eignung für
einen speziellen Zweck sowie die Garantie vor verdeckten oder
verborgenen Mängeln. Sofern diese Gewährleistungsansprüche
nicht ausgeschlossen werden können, beschränkt Ava die Dau-
er der Gewährleistungsansprüche und Rechtsmittel (sofern ge-
setzlich zulässig) auf die Dauer der vorliegenden Bestimmungen
und die Reparatur oder den Austausch des Produkts gemäss
den nachfolgend beschriebenen Bedingungen. Die Rechtssys-
teme einiger Länder erlauben keine Beschränkung der impli-
ziten Gewährleistungsfrist (oder Gewährleistungsbedingungen),
so dass die oben genannten Beschränkungen möglicherweise
nicht auf Sie zutreffen.
2. Produktgewährleistung
Ava gewährleistet für ein (1) Jahr ab Kaufdatum, dass das Pro-
dukt unter normalen Gebrauchsbedingungen keine Material-
oder Verarbeitungsfehler aufweist, es sei denn, in Ihrem Land
gelten längere Mindestfristen („Gewährleistungsfristen“).
3. Rechtsmiel
Wenn Sie innerhalb der Gewährleistungsfrist Gewährleistungs-
ansprüche an Ava stellen und das von Ihnen gekaufte Produkt
die Gewährleistungsanforderungen eindeutig und nachweis-
lich nicht erfüllt, so behält sich Ava vor: (i) den für das Pro-
dukt gezahlten Kaufpreis (exklusive Steuern und Versandkos-
ten) zurückzuerstatten; (ii) das Produkt durch ein neues oder
überarbeitetes Produkt (mit identischen Spezifikationen oder
gleichwertiger Funktion) zu ersetzen; oder (iii) das Produkt zu
reparieren. Dieser Abschnitt legt die alleinigen, gesetzlich fest-
gelegten Rechtsmittel fest. Produkte, die ohne die ausdrückli-
che Genehmigung seitens Ava zurückgesendet werden, können
nicht entgegengenommen werden.
Wenn ein Produkt gemäss diesen Gewährleistungsbestimmun-
gen ausgetauscht oder repariert wurde, so gilt eine weitere
Gewährleistungsfrist von: (i) der verbleibenden ursprünglichen
Gewährleistungsfrist; oder von (ii) dreissig (30) Tagen ab dem
Datum der Reparatur oder des Ersatzes oder von einer ande-
ren gesetzlich festgelegten Gewährleistungsfrist. Die Gewähr-
leistung gilt nicht für die im Produkt enthaltene Software oder
die von Ava angebotenen Dienstleistungen für die Produktei-
gentümer, noch für die Nutzung der von Ava bereitgestellten
Webseite und Applikation. Weitere Informationen zu Ihren Nut-
zungsrechten finden Sie in den Allgemeinen Geschäftsbedin-
gungen („AGB“).
4. Erfüllung von Gewährleistungsansprüchen
Das Produkt ist in der Originalverpackung oder einer gleichwer-
tig schützenden Verpackung an die von Ava angegebene Adresse
zu schicken. Je nach den geltenden gesetzlichen Bestimmun-
gen kann Ava einen Kaufbeleg und/oder die Registrierung des
Produkts verlangen, bevor Gewährleistungsansprüche erfüllt
werden. Sie sind für die Synchronisierung der auf dem Produkt
gespeicherten Daten verantwortlich. Diese Daten gehen bei der
Reparatur oder der Neuformatierung des Geräts sehr wahr-
scheinlich verloren, und Ava übernimmt keinerlei Haftung für
diese Art von Schaden oder Verlust. Des Weiteren übernimmt
Ava keine Haftung für den Verlust oder die Beschädigung von
Retouren. Der Einsender haftet für die Zahlung der Versandkos-
ten sowie für alle Risiken im Zusammenhang mit dem Verlust
oder der Beschädigung des Produkts während der Rücksendung
an Ava.
5. Ausnahmen und Beschränkungen
Vom Gewährleistungsanspruch ausdrücklich ausgenommen ist
Folgendes: (a) Verschleissteile, wie Armbänder, es sei denn, die
Beschädigung lässt sich auf Material- oder Verarbeitungsfehler
des Produkts zurückführen; (b) normale Abnutzungserschei-
nungen und oberflächliche Beschädigungen, wie zum Beispiel
Kratzer, Druckstellen, beschädigtes Verpackungsmaterial oder
beschädigte Kunststoffteile; (c) Defekte oder Beschädigungen,
die durch Veränderungen, aussergewöhnliche Belastung oder
Vorfällen hervorgerufen wurden (wie zum Beispiel Aufprall,
Modifizierungen, Feuer oder das Verschütten von Speisen oder
Getränken), Nachlässigkeit, Missbrauch, unsachgemässe Ver-
wendung, unsachgemässe oder nicht genehmigte Reparatur,
Installation, Verkabelung, unsachgemässe Aufbewahrung oder
Prüfung, Verwendung von nicht originalen Zubehörteilen, wie

Armbändern oder Kabeln, Fremdanwendungen, die auf das Pro-
dukt geladen wurden, oder das Entfernen der Seriennummer;
(d) Schäden, die durch die unzulässige und unsachgemässe
Verwendung des Produkts verursacht wurden; (e) Schäden, die
durch die Verwendung mit Fremdprodukten verursacht wurden;
(f) fremde Hardware- oder Softwareprodukte, selbst wenn sie
mit dem Produkt zusammen verpackt und verkauft wurden;
und (g) Produktmodifizierungen, die nicht von Ava vorgenom-
men wurden. Ava behält sich das Recht vor, das Produkt zu
deaktivieren, wenn der Verdacht besteht, dass es sich um ein
gefälschtes Produkt handelt, oder wenn Ava herausfindet, dass
das Produkt gefälscht, gestohlen oder beim Versand verloren
gegangen ist. Die Gewährleistung gilt nicht für die im Produkt
enthaltene Software oder für die Dienstleistungen, die Ava dem
Produkteigentümer anbietet. Weitere Informationen zu Ihren
Nutzungsrechten finden Sie in den Allgemeinen Geschäftsbe-
dingungen („AGB“).
6. Implizite Gewährleistungsansprüche
MIT AUSNAHME DER GESETZLICH ZUGESICHERTEN RECHTE
WERDEN ALLE IMPLIZITEN GEWÄHRLEISTUNGSANSPRÜCHE
(EINSCHLIESSLICH DER ZUSICHERUNG DER ALLGEMEINEN
GEBRAUCHSTAUGLICHKEIT ODER DER GEWÄHRLEISTUNG DER
EIGNUNG FÜR EINEN SPEZIELLEN ZWECK) ABGELEHNT ODER,
FALLS DIES GESETZLICH NICHT ZULÄSSIG IST, AUF DIE DAUER
DER HIER GENANNTEN GEWÄHRLEISTUNGSFRIST BEGRENZT.
Die Rechtssysteme einiger Länder verbieten eine Beschränkung
der impliziten Gewährleistung, weshalb die oben genannte Be-
schränkung in Ihrem Land möglicherweise nicht zutrifft.
7. Schadensbegrenzung
AVA HAFTET NICHT FÜR INDIREKTE, ZUFÄLLIGE, SPEZIELLE
ODER FOLGESCHÄDEN BZW. STRAFSCHADENSERSATZ, UN-
ABHÄNGIG DAVON, OB DIESE AUS EINER KLAGE WEGEN VER-
TRAGSBRUCH (EINSCHLIESSLICH DEM VERLUST VON UMSATZ,
VERWENDUNG, GEWINN, DATEN, KULANZ ODER KOSTEN FÜR
DIE BESCHAFFUNG VON ERSATZPRODUKTEN), UNERLAUBTER
HANDLUNG, PRODUKTHAFTUNG ODER ANDEREN GRÜNDEN
ODER HAFTUNGSTHEORIEN HERVORGEHEN, DIE IM ZUSAM-
MENHANG MIT DIESER GEWÄHRLEISTUNG ODER DEM KAUF,
VERKAUF, GEBRAUCH, BETRIEB ODER DER LEISTUNG DIESER
PRODUKTE STEHEN. AVA UND DER KÄUFER VEREINBAREN,
DASS DIESE BESCHRÄNKUNGEN AUCH DANN GELTEN, WENN EI-
NES DER IN DIESEN BEDINGUNGEN GENANNTEN BESCHRÄNK-
TEN RECHTSMITTEL SEINEN URSPRÜNGLICHEN ZWECK NICHT
ERFÜLLT HAT. SIE BESTÄTIGEN, DASS DER EVENTUELL AUS
DIESER VEREINBARUNG ODER DEN DIENSTLEISTUNGEN HER-
VORGEHENDE GESAMTHAFTUNGSANSPRUCH GEGENÜBER AVA
FÜR ALLE ARTEN VON FORDERUNGEN, KLAGEN, VERLUSTEN,
SCHÄDEN ODER URTEILEN DIE KOSTEN DES PRODUKTS BZW.

UTILISATION PRÉVUE
Le bracelet Ava tracker de fertilité est un dispositif médical
non-invasif conçu pour mesurer et afficher les paramètres phy-
siologiques en vue d'aider les femmes à prévoir leur ovulation et
faciliter la conception. D'autres paramètres recueillis améliorent
la qualité des prévisions et fournissent diverses informations
sur la santé et le bien-être de la patiente.
La température constitue le paramètre le plus important de la
prédiction de la période de fécondité selon le bracelet Ava tra-
cker de fertilité. La technologie tracker de fertilité fonctionne de
paire avec l'historique de vos données menstruelle. Le bracelet

GARANTIE, N’UTILISEZ PAS LE PRODUIT.
1. Champ d’application de la garantie
La garantie ne s’applique qu’à l’acheteur initial («vous») qui a
acheté le produit à une source autorisée.
La garantie vous accorde des droits spécifiques, mais vous pouvez
avoir d’autres droits qui varient selon les juridictions, y compris
des droits relevant de la protection des consommateurs. Dans
la mesure autorisée par la loi, la présente garantie et les voies
de recours exposées sont exclusives et remplacent toutes les
autres garanties, voies de recours et conditions qu’elles soient
orales, écrites, légales, expresses ou implicites. Ava décline toutes
garanties légales et implicites, y compris, mais sans s’y limiter,
les garanties de qualité marchande et d’adéquation à un usage
particulier ainsi que les garanties contre les vices cachés, dans la
mesure permise par la loi. Si ces garanties ne peuvent être exclu-
es, Ava limite la durée et les voies de recours de telles garanties
à la durée de la garantie (dans la mesure permise par la loi) et, à
la convenance d’Ava, à la réparation ou au remplacement comme
décrits ci-dessous. Certaines juridictions n’autorisent pas la limit-
ation de la durée d’une garantie (ou condition) implicite, auquel
cas la clause précédente ne vous concerne pas.
2. Garantie du produit
Ava garantit le produit exempt de tout défaut matériel de fa-
brication et de matériaux, en conditions d’utilisation normale,
pendant une période d’un (1) an à compter de la date d’achat,
sous réserve que des dispositions impératives dans votre juri-
diction n’exigent des périodes minimales plus longues («période
de garantie»).
3. Voies de recours
Si vous présentez une demande au titre de la garantie à Ava
avant la fin de la période de garantie et que votre produit ne
répond manifestement et indubitablement pas à la garantie, Ava
opte, à sa seule discrétion, pour : (i) vous rembourser le montant
du prix payé pour le produit (hors taxes et frais de port), (ii) éch-
anger le produit contre un nouveau ou un produit remis à neuf
(échange de produit ayant des spécifications identiques ou des
fonctionnalités équivalentes) ou (iii) réparer le produit. Ce point
énonce votre seule et unique voie de recours, dans la mesure
autorisée par la loi. Les retours effectués sans l’autorisation
préalable et explicite d’Ava ne seront pas acceptés.
Si un produit a été échangé ou réparé conformément à la pré-
sente garantie, il fera l’objet d’une garantie : soit (i) pour la péri-
ode restante de la garantie initiale, soit (ii) pour une durée de
trente (30) jours à compter de la date de réparation ou de rem-
placement ou pour une durée supplémentaire applicable dans
votre juridiction. Cette garantie ne couvre pas le logiciel intégré
au produit ni les services fournis par Ava aux propriétaires du
produit ni votre utilisation du site et de l’application fournie
par Ava. Veuillez vous référer aux Conditions d’utilisation pour
connaître le détail de vos droits à cet égard.
4. Accès aux prestations de la garantie
Vous devez retourner le produit à l’adresse indiquée par Ava soit
dans son emballage d’origine, soit dans un emballage offrant un
degré de protection équivalent. Conformément à la loi appli-
cable, Ava peut vous demander de fournir une preuve d’achat
et/ou d’enregistrer le produit avant de pouvoir bénéficier de la
garantie. Il est de votre responsabilité de synchroniser toutes
les données stockées dans le produit. Il est probable que ces
données seront perdues ou reformatées pendant la révision de
l’appareil et Ava décline toute responsabilité en cas de dom-
mage ou de perte des données. Ava décline toute responsabilité
en cas de retours perdus ou endommagés. Les frais de port sont
à votre charge. Les risques de perte ou de dommage du produit
lors de l’expédition à Ava sont de votre responsabilité.
5. Exclusions et limitations
Cette garantie ne couvre pas et exclut explicitement : (a) les
pièces consommables tels que le bracelet en soi, à moins que
le dommage soit dû à un défaut de matériaux ou de fabrication
du produit ; (b) l’usure normale et les dommages esthétiques, y
compris, mais sans s’y limiter, les rayures, les bosses, les maté-
riaux d’emballage endommagés ou pièces en plastique abîmées
; (c) les défauts ou les dommages dus à une altération, une
sollicitation inhabituelle, un accident (y compris, mais sans s’y
limiter : collision, modification, incendie et renversement de
nourriture ou de liquide), la négligence, l’abus, l’utilisation in-
correcte, une réparation inappropriée ou non autorisée, l’instal-
lation, le câblage, un entreposage ou un essai inadéquat, l’uti-
lisation d’accessoires de tiers tels que bracelets ou câbles, des
applications tierces téléchargées sur le produit ou si le numéro
de série a été supprimé ; (d) les dommages causés par l’utilisa-
tion du produit en dehors des utilisations permises ou prévues
décrites par Ava ; (e) les dommages causés par l’utilisation avec
des produits qui ne sont pas des produits Ava ; (f) le matériel
qui n’est pas de la marque Ava ou tout logiciel, même si emballé
ou vendu avec le produit et (g) les modifications apportées au
produit par des personnes extérieures à Ava. Ava se réserve le
droit de désactiver le produit si Ava soupçonne une fraude ou
découvre que le produit est contrefait, volé ou perdu durant
l’expédition. La garantie ne couvre pas les logiciels intégrés
au produit et les services fournis par Ava aux propriétaires du
