BEFORE OPENING OR UTILIZING THE ENCLOSED PRODUCT,
CAREFULLY READ THIS LICENSE AGREEMENT.
Thisdocumentisanagreement(“Agreement”)betweentheenduser(“You”)and
Enterasys Networks, Inc.onbehalfofitselfanditsAffiliates(ashereinafterdefined)
(“Enterasys”)thatsetsforthYourrightsandobligationswithrespecttothe
Enterasyssoftwareprogram/firmwareinstalledontheEnterasysproduct(including
anyaccompanyingdocumentation,hardwareormedia)(“Program”)inthepackage
andprevailsoveranyadditional,conflictingorinconsistenttermsandconditions
appearingonanypurchaseorderorotherdocumentsubmittedbyYou.“Affiliate”
meansanyperson,partnership,corporation,limitedliabilitycompany,orotherform
ofenterprisethatdirectlyorindirectlythroughoneormoreintermediaries,controls,
oriscontrolledby,orisundercommoncontrolwiththepartyspecified.This
Agreementconstitutestheentireunderstandingbetweentheparties,andsupersedes
allpriordiscussions,representations,understandingsoragreements,whetheroral
orinwriting,betweenthepartieswithrespecttothesubjectmatterofthis
Agreement.TheProgrammaybecontainedinfirmware,chipsorothermedia.
