NOTICE TO CONSUMERS UNDER AUSTRALIAN CONSUMER LAW
OurgoodsandservicescomewithguaranteesthatcannotbeexcludedundertheAustralianConsumerLaw.
Foramajorfailurewithagood,youareentitledtoareplacementorrefundandcompensationforanyother
reasonableforeseeablelossordamage.Ifthefailuredoesnotamounttoamajorfailureandifthegoodsfailto
beofacceptablequality,youarealsoentitledtohavethegoodsrepairedorreplaced.
Foramajorfailurewiththeservice,youareentitledtocancelyourservicecontractwithusandobtainarefund
fortheunusedportion,ortocompensationforitsreducedvalue.Youarealsoentitledtobecompensatedforany
otherreasonablyforeseeablelossordamage.Ifthefailuredoesnotamounttoamajorfailureyouareentitledto
haveproblemswiththeservicerectiedinareasonabletimeand,ifthisisnotdone,tocancelyourcontractand
obtainarefundfortheunusedportionofthecontract.
ThebenetsprovidedbythisWarrantyareinadditiontoanyotherrightsandremediesavailabletoaconsumer
undertheAustralianConsumerLawandanyotherlawwhichmayapplytothegoodsandorservices.
1 DEFINITIONS
Thetermslistedbelowshallhavethefollowingmeanings:
1 “Authorised Service Representative” means an independent service contractor authorised by Rinnai or
Rinnaiservicepersonnel.
2 “Rinnai”meansRinnaiAustraliaPtyLtd(ABN74005138769)andanyrelatedcompany.
3 “Certicate(s) of Compliance” means certicate(s) issued by licensed personnel (including plumbers,
refrigerationmechanics,electriciansorotherrelevanttradespeople)tocertifythatanyprescribedworkscomply
withapplicableregulatoryrequirements.
4 “Certicate(s) of Occupancy” means certicate(s) issued by the local government authority (or similar
organisation)whichcertiesthatahomecanbeoccupied.
5 “InstallationSite”meansthesiteatwhichtheProductisoriginallyinstalled.
6 “NormalBusinessHours”means8:30amto5:00pmMondaytoFriday,excludingpublicholidays.
7 “Operating/Installation Instructions” means the user manual or other documentation which provides
detailedinstructionsontheproperoperationandmaintenanceoftheProduct.
8 “Other Applications” means any Product used for purposes other than Residential & Light Commercial
Applications.OtherApplicationsmayincludebutarenotlimitedtofactory,IT/Serverroom,telephoneexchange,
processingarea(e.g.bakery,kitchen,warehouse,swimmingpool,agriculturalfacilitiessuchasanursery).
AnyProductwhichhasbeeninstalled,forwhateverpurpose,asaretrotcomponenttoanexistingsystem,will
alsobeclassedasbeingpartofan“OtherApplication”regardlessofthepurposeofuseoftheexistingsystem
intowhichsuchproducthasbeeninstalled.
9 “Purchaser”meanstheenduseroftheProduct,thepersonnamedasownerintheWarrantycerticate,the
holderoftheProofofPurchaseortheholderofapropertytransferdocumentwheretheProductisincluded
aspartofthechattels.
10 “Product”meanstheequipmentpurchasedbythePurchaseranddescribedinSection2ofthisdocument.
11 “ProofofPurchase”meansaTaxInvoiceorReceiptinrespectoftheProduct.Inthecaseofnewconstructions,
aCerticateofOccupancyoraCerticateofCompliancethatdetailsthedateofinstallationorcommissioning
willsuce.
12 “Qualied Installer” means the qualied installation contractor who is responsible for performing the
installationworkinthemannerprescribedbylocalandstatutoryregulations,includingcompliancewithany
relevantandtoRinnaispecications,includingAustralianStandards.
13 “Residential&LightCommercialApplications”meansanyProductforuseinresidentialorlightcommercial
applicationswhere
a) theProductissolelyusedforthepurposeofhumancomfort;and
b) the ambient temperature of the space the Product is intended to heat or cool is inuenced solely or
primarilybynaturalexteriorweatherconditionsratherthanbyman-madeormechanicalheatsources.
Examples of Residential & Light Commercial Applications include, homes, oces, hotels, apartments,
nursinghomes,hospitals,healthcarepremises,shoppingcentres,andretailstores.
