Roper Whit ney ( “ Manufact urer” ) warrant s, com m encing wit h the dat e of shipm ent t o first end-user
( “ Cust om er ” ) and for a per iod of t hir t y- six ( 36) m ont hs t her eaft er, all m achinery and part s
m anufact ured by Manufact ur er to be free of defect s in workm anship and m at erial. Th is w a r r an t y
re m a in s in for ce for t he a bove tim e period only if a ll of Manufa ct ur er’s operat ion al
procedu res a re follow e d a nd recom m ende d m a inte nan ce is pe rform e d. I f, within such
warrant y period, any machinery or part s m anufactured by Manufact urer shall be proved to
Manufact urer’s sat isfact ion to be defect ive, such m achinery or parts shall be repaired or replaced,
at Manufact urer’s opt ion. All warranty claim s are m ade F.O.B Manufact urer ’s plant, providing such
m achinery or parts are ret urned freight prepaid to Manufact urer’s plant or designated service
cent er for Manufacturer’s inspect ion. All failed parts or com ponents m ust be ret urned t o
Manufact urer prepaid for inspect ion before credit will be issued for new parts or com ponents.
Manufact urer’s obligation hereunder shall be confined t o such repair or replacem ent and does not
include any charges, direct or indirect , for rem oving or replacing defective m achinery or part s. No
warranty shall apply t o m achinery, or part s or accessories, which have been furnished, repaired, or
alt ered by others so as, in Manufact urer ’s j udgm ent, t o affect t he sam e adversely or which shall
have been subject to negligence, accident or im proper care, inst allation, m aintenance, st orage, or
ot her t han norm al use or service, during or after shipm ent . No warranty shall apply to t he cost of
repairs m ade or at tem pted out side of Manufacturer’s plant or designated service center wit hout
Manufact urer’s aut horization. No warranty shall apply wit h respect to machinery or part not
m anufact ured by Manufact urer, including but not lim it ed t o m ot ors, accessories, electr ical and
hydr aulic com ponent s, if such m achinery or par t is subj ect t o warr ant y by the m anufacturer of
such m achiner y or par t. No war rant y claim s by Cust om er will be honor ed w ith respect t o any
m achinery or part from which the nam e and dat e plat e has been rem oved or is ot herwise no longer
locat ed or exhibit ed on such m achinery or part . TH E FOREGOI N G W ARRAN TI ES ARE I N LI EU OF
