Limited Warranty
SOFTWARE: SMC warran ts that t he s oft ware programs licens ed f rom it wi ll perform
in substantial conformance to the program specifications for a period of ninety (90)
days fr om the date of p urc hase fro m SM C o r its Au th or ized Resell er. SM C war rants
the magn etic m edi a c ont ainin g so ft ware against f ail ure d uring th e w arr anty perio d.
No updates are provided. SMCís s ole obligation hereunder shall be (at SMC’s
discretion) to refund the purchase price paid by Customer for any defective
software products or to replace any defective media w ith software which
substantially conforms to SMC’s applicable published specifications. Customer
assumes respons ibility for the selection of the appropriate applications program
and associ ated reference materials. SMC makes no warranty that its software
products will work in combinati on with any hardware or applications software
products provided by third parties, that the operation of the software products will
be uninterrupted or error free, or that all defect s in the software products will be
corrected. F or any third party products lis ted in the SMC software product
documentation or specifications as being compatibl e, SMC will make reasonable
efforts to prove compatibi lity, except where the non-compatibility is caused by a
ìbugî or defect in the third partyís product.
STA NDA RD WAR RANTY SERVIC E: Standard warranty service for hardware
pro du cts m ay b e o btain ed by deliverin g t he def ect ive produ c t, ac com pan ied by a
co py of the dated proo f of purchase, to SMC’s Service Center or t o an A uth orized
SMC Service Center during the applicable warranty period. Standard warranty
service for software products may be obtainedby telephoning SMC’s Service Center
or an A uthorized SMC Service Center, wi thin the warranty period. Products returned
to SMC’s Service Center must be pre-authorized by SMC with a Return Material
Authorization (RMA) number marked on the outside of the package, and sent
prepaid, insured, and packaged appropriately for safe shipment. The repaired or
replaced item wi ll be shipped to Customer, at SMC’s expense, not later than thirty
(30) days after receipt by SMC.
WA RRA NTIES EXCLUSIVE: IF AN SMC PRODUCT DOES NOT OPERATE AS
WARRANTED ABOVE, CUSTOMERíS SOLE REMEDY SHALL BE REPAIR,
RE PLACE ME NT OR RE FUN D O F T HE PU RCHASE P RI CE PAI D, AT SMC’S O PT IO N.
THE FOREGOING WARRANTIES AND REMEDIES ARE EXCLUSIVE AND ARE IN
LIEU OF ALL OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED,
EITHER IN FACT OR BY OPERATION OF LAW, STATUTORY OR OTHERWISE,
INCLUDING WARRANTIES OR CONDITIONS OF MERCHANTABILITY AND
FITNESS FOR A PARTICULAR PURPOSE. SMC NEITHER ASSUMES NOR
AUTHORIZES ANY OTHER PERSON TO ASSUME FOR IT ANY OTHER LIABILITY
IN CONNECTION WITH THE SALE, INSTALLATION, MAINTENANCE OR USE OF
IT S P RO DUCT S.
SMC SHALL NOT BE LIABLE UNDER THIS WARRANTY IF ITS TESTING AND
EXAMINATION DISCLOSE THE ALLEGED DEFECT IN THE PRODUCT DOES NOT
EXIST OR WAS CAUSED BY CUSTOMERíS OR ANY THIRD PERSON’S MISUSE,
NEGLECT, IMPROPER INSTALLATION OR TESTING, UNAUTHORIZED ATTEMPTS
TO REPAI R, OR A NY OTHER CA USE BE YOND THE RA NGE OF THE INTEN DE D
