Subject tothe terms andconditions set forth herein, D-Link Systems, Inc. (“D-Link”)providesthis Limited warranty forits product
only to the person or entity thatoriginally purchased the product from:
l D-Link or itsauthorized reseller ordistributorand
l Products purchased and deliveredwithin the fiftystates of the UnitedStates, theDistrict of Columbia, U.S. Possessions
orProtectorates, and U.S. Military Installations, addresses with an APO or FPO.
LimitedWarranty: D-Linkwarrants that the hardwareportion of the D-Linkproducts described below will be free from material
defectsin workmanship and materialsfrom the date of original retail purchase of the product,for the period set forthbelow
applicable to the product type (“WarrantyPeriod”), except as otherwise stated herein.
5-YearLimited Warranty for the Product(s) is defined as follows:
l Hardware (excluding powersupplies and fans) Five (5) Years
l Power Supplies and Fans Three (3) Year
l Spare parts and spare kitsNinety (90) days
D-Link’ssole obligation shall be torepairor replace the defective Hardware during the Warranty Period atno charge to theoriginal
ownerortorefund at D-Link’ssole discretion. Such repair or replacement will be renderedby D-Link at anAuthorized D-Link
Service Office. The replacement Hardware need notbenew orhave an identical make, model or part. D-Linkmayin its sole
discretion replacethe defectiveHardware(or anypart thereof) withany reconditionedproductthatD-Link reasonably determines is
substantially equivalent(or superior)in all material respects to the defective Hardware. Repaired orreplacementHardware will be
warranted for the remainder of the original Warranty Period fromthe date of original retail purchase. Ifamaterial defectis
incapable ofcorrection, or if D-Linkdetermines in its sole discretion that it is not practical torepairor replace the defective
Hardware, the price paid by the original purchaser for the defectiveHardwarewill be refunded by D-Link upon returnto D-Link of
the defective Hardware. All Hardware (or partthereof) that is replacedby D-Link, orfor whichthe purchase price is refunded, shall
become the property of D-Link upon replacement or refund.
LimitedSoftware Warranty: D-Link warrants that thesoftware portionof the product (“Software”)will substantially conformto
D-Link’sthen currentfunctionalspecifications for the Software, as set forthin the applicable documentation, fromthe dateof
originalretail purchase of the Software foraperiod of ninety (90)days (“Warranty Period”), provided that the Software is properly
installed on approved hardwareand operatedas contemplated in itsdocumentation. D-Link furtherwarrants that, during the
Warranty Period, the magnetic media on which D-Link deliversthe Software will be free of physical defects. D-Link’ssole obligation
shall be to replace the non-conformingSoftware (ordefective media) withsoftware that substantially conforms to D-Link’s
functional specificationsfor the Softwareorto refundat D-Link’ssole discretion.Exceptasotherwise agreed by D-Linkin writing,
the replacementSoftwareis provided only tothe originallicensee, and is subject tothe terms and conditions of the license granted
by D-Link for the Software. Software will be warranted for the remainder ofthe original Warranty Periodfromthe date or original
retail purchase. If amaterial non-conformance is incapable of correction, orif D-Linkdetermines inits sole discretion that itis not
practical to replace the non-conforming Software, the price paidby the original licensee forthe non-conformingSoftwarewill be
refundedby D-Link; provided that the non-conformingSoftware(andall copies thereof) is first returned to D-Link. Thelicense
granted respecting any Software forwhich a refund is givenautomatically terminates.
Non-ApplicabilityofWarranty: The Limited Warranty provided hereunder forhardware andsoftware of D-Link's products, will
not be applied toand does notcover any product purchased through the inventoryclearance orliquidation sale orothersales in
whichD-Link, the sellers, or the liquidators expressly disclaim theirwarranty obligation pertainingto the productand inthatcase,
the product is being sold "As-Is"withoutany warranty whatsoeverincluding, withoutlimitation, the Limited Warranty as described
herein, notwithstanding anythingstated herein to the contrary.
SubmittingAClaim:Any claim under this limited warranty must be submitted in writing beforethe end of the Warranty Period to
an Authorized D-Link Service Office.
l Thecustomer mustsubmitas partof the claim a written descriptionof the Hardware defect orSoftwarenonconformance
in sufficient detail to allowD-Link to confirm the same.
l Theoriginal product ownermust obtain aReturn MaterialAuthorization (“RMA”)number from the Authorized D-Link
ServiceOffice and, if requested, provide written proof of purchase of the product (such asacopyof the dated purchase
invoice for the product) before the warrantyservice is provided.
l After an RMA number is issued, the defective product must be packaged securely in the original or other suitable
shippingpackage to ensure that itwill not bedamagedin transit, andtheRMAnumbermustbe prominently marked on
the outside of the package. Do notinclude any manuals or accessoriesinthe shipping package. D-Link will only replace
the defective portion of the Productand will not shipback any accessories.
l Thecustomer is responsible for all shippingcharges to D-Link.NoCharge onDelivery (“COD”)is allowed. Products sent
COD will either be rejected by D-Link or become the property ofD-Link. Productsshould befully insured by the
customerand shipped toD-LinkSystems, Inc., 17575 Mt. Herrmann, Fountain Valley, CA 92708. D-Link will not be
held responsible forany packages that arelost in transit toD-Link. Therepaired or replaced packageswill be shipped
via UPS Groundor any commoncarrier selected by D-Link, with shipping charges prepaid. Expedited shipping is
available if shippingchargesare prepaid bythe customer.
D-Link mayrejector return anyproduct that is notpackagedand shipped in strictcompliance with the foregoing requirements,or
for whichan RMA numberis not visible from the outside ofthe package. Theproduct owneragrees topay D-Link’sreasonable
handlingand returnshipping charges forany product that is not packaged andshipped in accordancewiththe foregoing
requirements, or that is determinedby D-Link not tobe defective or non-conforming.
What Is Not Covered: This limited warranty provided by D-Linkdoes not cover:Products, if in D-Link’sjudgment, have been
subjectedto abuse, accident, alteration, modification, tampering, negligence, misuse, faultyinstallation, lackof reasonable care,
