Delay in Delivery: Delay in completion of work, delivery or in case of a contract for delivery by installments, delay in delivery of an installment shall not give rise
to any liability upon the company whether or not any time of date is given in this respect and shall not entitle the customer to terminate the contract.
Liability: All goods are guaranteed to do the work for which they are designed. If the goods or any part thereof are defective solely as a result of faulty
materials or workmanship of the company, the company’s liability shall be limited, at it’s discretion either to replacing such goods or the defective parts. But no
such liability shall arise unless notification of any defect is received by the company in writing within 90 days from the receipt of goods by the buyer and the
allegedly defective goods are thereafter returned to the company carriage paid with appropriate
pre–notification.
Indemnity: The customer shall indemnify the company against all claims in respect of any loss, injury or damage sustained by a third party arising from the sales
of the goods to the buyer how so ever caused and also against all actions, proceedings, costs, claims, demands and expenses made, brought or claimed against
the company in respect of the infringement of any patent, trademark or registered design.
