Warranty stipulations concerning the wheelchair
In t e following warranty and liability stipulations t e terms and definitions as summed up ereafter must be
explained as follows:
•
Product: T e manually operated or electric w eelc air or electric scooter manufactured and delivered
by Handicare.
•
Customer: T e person w o directly obtains a Product from Handicare or an aut orised representative.
•
Dealer: T e person w o delivers a Product obtained from Handicare to customers or t ird parties.
•
User: T e person w o uses a Product manufactured by Handicare.
Irrespective of w at is determined concerning warranty conditions applicable to t e Product, in any case t e
following applies wit regard to t e warranty:
1. Except insofar as described ot erwise Handicare guarantees t e Product for its suitability for t e purpose for
w ic t e Product is intended - all of t ese points as described in t is manual - and for t e quality of t e
material of w ic t e Product is made and t e manner in w ic t e Product is manufactured.
2. Repairs or replacement of parts of t e Product t at may be necessary as a result of faults t at are based on
qualitatively faulty material or manufacturing errors will be executed free of c arge, as long as suc faults
occurred wit in one (1) year after t e date of delivery of t e Product to t e Customer. T e parts to be replaced
must be s ipped postage-paid to Handicare. Installation or removal of t ese parts is for t e Customer’s
account. T erefore, t e following cases are not eligible for free repair or replacement as meant above:
- T e repair or replacement t at is necessary in connection wit faults t at arise after one (1) year after t e
date of delivery of t e Product to t e Customer;
- T e repair or replacement t at is required in connection wit faults due to improper or careless use of t e
Product or t at are based on t e Product being used for anot er purpose t an t e one for w ic it is
intended, in w ic regard it applies t at if t e Customer is a Dealer, t is Dealer will indemnify Handicare
against possible claims from Users or ot er t ird parties for faults based on an incorrect or careless use
of t e Product;
- Parts t at are subject to wear and t e need for repair or replacement of t e parts are t e actual
consequence of normal wear. T ese can include, but are not limited to, tyres, s rouds, arm-pads, seating
etc.
3. Irrespective of t at stipulated under 2, it applies as far as an electric Product is concerned t at wit regard to
t e battery t at forms part of t e Product warranty is only given in case of faults or non-functioning of t e
battery t at are demonstrably t e direct consequence of material or manufacturing errors. A fault or non-
functioning of t e battery as a result of normal wear is not covered by t e warranty as meant in t ese warranty
stipulations. Similarly not covered by t e warranty are faults or non-functioning t at are t e consequence of
improper or unprofessional use of t e Product or t e battery t at is part of t e Product, including t e incorrect
c arging of t e battery and t e failure to carry out timely and good maintenance, in w ic context it also
applies t at if t e Customer is a Dealer, t is Dealer will indemnify Handicare against possible claims from
Users or ot er t ird parties t at are based on t e above mentioned improper or unprofessional use of t e
Product or t e battery t at is part of t e Product. Handicare does not guarantee batteries provided by dealers
or purc ased by t e customer.
4. T e warranty conditions as mentioned in above stipulations in any case become null and void if:
- T e guidelines of Handicare for t e maintenance of t e Product are not, or insufficiently, followed;
- A necessary repair or replacement of parts is based on neglect, damage or abuse of t e Product or a use
of t e Product for anot er purpose t an t e one for w ic it was intended;
- Parts of t e Product are replaced by parts of anot er origin t an t ose used by Handicare and/or parts of
t e Product are replaced wit out t e permission of Handicare.
5. T e warranties as mentioned in stipulations 1 t roug 3 also become null and void if w at is involved is re-
used by a new user wit in t e warranty period and t at suc re-use necessitates adaptations to t e w eelc air
and t ose adaptations are carried out wit out t e instructions and/or at t e order of Handicare.
6. To retain rig ts under t e warranties delineated above, t e Customer must, in case of damage or ot er
calamities, as rapidly as possible contact Handicare and inform t em as fully as possible. T e possibility of
taking recourse to t e above-mentioned warranty conditions becomes null and void for t e Customer in any
case after 20 workdays after t e claim situation or t e calamity arises t at was t e reason for t e recourse to
t e warranty.
7. T e replacement of a part or t e repair or t e reconditioning of t e Product wit in a current warranty period
does not extend t e warranty period.
8. Handicare gives no warranty on repair to or reconditioning of t e Product carried out ot er t an under order of
and/or at t e instructions of Handicare. If repairs and/or reconditioning are executed by or on be alf of a
Customer, t e Customer indemnifies Handicare wit respect to t e claims of t ird parties t at result, in t e
broadest sense of t e word, from suc repairs or reconditioning.
