areavailabletoassistyou.Thetermsandconditions of SMART’ s warranty are set forth below – please review them carefully. P leaseseethe
reversesideofthispageforwarranty-claimprocedures.
LimitedWarrantytoEnd-UserPurchaser
Subjecttotheexceptionsnotedbelow, this limited warranty (the “Warranty”) covers all defects in materials and workmanship of your new
SMARThardwareproduct,togetherwithincludedsoftwaredistributionmedia, pens, eraser and cables (the “Equipment”). SMART extends the
Warrantytotheend-userpurchaser(the“Purchaser”)oftheEquipment.
ThedurationoftheWarranty (the “Warranty P eriod”), commencing on the date of newpurchase, is ONE YE AR for optional
accessories(includingroomcontrolmodules, wireless serial or USB connections, floor stands, speakers, cables, USB adapters,
keyboards,etc.)andservicerepairparts,withthefollowing exceptions:
FullydischargedSMARTSlate™lithiumionbatteriesarenotcovered by warranty.
Projectorlamps(usedundernormalprojector operating conditions, not in excess of 8 hours per day and 260 days per year) are
coveredbywarrantyfor500hoursor90days, whichever comes first.
THEWARRANTYISINLIEUOFALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING BUT NOT
LIMITEDTOIMPLIEDWARRANTIESOFMERCHANTABILITYANDFITNESSFORA PARTICULAR PURPOSE.ANY REPRESENTATION
ORWARRANTY,ORAFFIRMATIONOFFACT,MADEBYANYSALES REPRESENTATIVE OR OTHER AGENT OF SMART, INCLUDING
BUTNOTLIMITEDTOSTATEMENTSREGARDINGCAPACITY, SUI TABILITY FOR USE OR PERFORMANCE, EXPRESS OR IMPLIED,
WHICHISNOTSPECIFICALLYSETFORTHHEREINWILL NOT BE BINDING UPON SMART.
SMARThasnotauthorizedany other party to alter, modify, extend, enhance or limit the Warranty and SMART will not assume any
responsibilityorliabilityforanystatementsorrepresentationsmadeby any other persons or entities.
RepairorReplace
ThePurchaser’sexclusiveremedyandSMART’s sole obligation duringthe Warranty Period shall be for SMART to repair or, at its option,
replacetheEquipmentthathasfailedorthathas proven to be defective at no cost to the Purchaser except for the one-way shi pping cost of the
EquipmenttoaSMART-authorizedservice center. Any charges associated with a rush-requested order, such as air express, are the
responsibilityofthePurchaser.Priortoreturning any equipment under the Warranty, the Purchaser must render proof of the original
purchasedateandmustthereafterobtainfromSMART a Return of Merchandise Authorization (RMA) number . The RMA number shall
beclearlymarkedonthepackagingoftheEquipmentbeing returned.AllreturnedEquipmentthatisreplacedundertheWarranty shall become
thepropertyofSMART.
LimitationofDamages
TheliabilityofSMARTtothePurchaserarisingoutof the purchase and supply of the Equipment or its use, whether based upon Warranty,
contract,tort(including,withoutlimitation,negligence)orotherwise,shall not in any case exceed the original cost to the Purchaser of the
Equipment,anduponexpirationoftheWarrantyPeriodsuchliability will terminate.
SMARTshallnotbeliable,whetherincontractor on any other basis, for any damages sustainedbythePurchaseroranyotherpersonarising
fromorrelatedtoloss of use, failure or interruption inthe operation oftheEquipment,delayinrepair or replacement or for incidental,
consequential,indirectorspecialdamagesorliabilities,loss of revenue, loss of business or other financial loss arising out of orinconnection
withthesale,lease,maintenance,use,performancefailureor interruption of the Equipment.
WarrantyExclusions
TheWarrantywillnotapplytoandSMARTwill not be liable for (i ) any Equipment which is not purchasedfromanauthorizedSMARTdealeror
distributor;(ii)Equipmentthathasbeendamaged by accident, abuse, neglect, misuse or causes other than ordinary use (see manuals that
shipwithEquipmentforfurtherdetail),includingthedirect application of any cleani ng liquids, substances or abrasives to t he hardware or onto
anydisplaysurfaceotherthanin accordance with the cleaning and care instructions included in the User’s Guide for the Equipment; (iii)
Equipmentwhichhasbeenaltered,changed, serviced or repaired by anyone other than SMART-authorized repair personnel; or (iv) any
Equipmentonwhichtheserialnumberhas been defaced, modified or removed. Warranty service hereunder shall not operate to extend the
originalWarrantyPeriod.TheWarranty excludes damage incurred in shipment to or from SMART. If the Equipment is received by the
Purchaserinadamagedcondition,the carrier and SMART must be notified immediately. Purchasers located outside the U.S. or Canada
shouldinsteadcontactthecarrierandtheirSMARTdealeror distributor.
Third-PartyEquipmentWarrantyExtensionandException
ForequipmentsoldbySMARTto the Purchaser but manufactured by a corporation other than SMART (such as wall-mounted cabinets,
carryingcasesandotherspecifiedcomponents),SMARTshallextend to the Purchaser, to the extent permitted, any and all applicable warranty
provisionsprovidedtoSMARTbythe third-party manufacturer. The extension of any and all applicable third-party manufacturerwarranty
provisionsshallbeanexceptiontothisWarrantyand representsSMART’s sole responsibilitywithrespecttosuchequipment.
