areavailabletoassistyou.Thetermsandconditionsof SMART’ s warranty are set forth below – please reviewthem carefully.Pleaseseethe
reversesideofthispageforwarranty-claimprocedures.
LimitedWarrantytoEnd-UserPurchaser
Subjecttotheexceptionsnotedbelow,this limited warranty (the “Warranty”)covers all defects in materials and workmanship of your new
SMARThardwareproduct,togetherwithincludedsoftwaredistributionmedia,pens,eraser and cables (the “Equipment”).SMART extends the
Warrantytotheend-userpurchaser(the“Purchaser”)oftheEquipment.
ThedurationoftheWarranty (the “Warranty Period”), commencing on the date of new purchase, is ONE YEAR for optional
accessories(includingroomcontrolmodules, wireless serial or USB connections, floorstands,speakers,cables,USB adapters,
keyboards,etc.)andservicerepairparts,withthefollowing exceptions:
FullydischargedSMARTSlate™lithiumionbatteriesarenotcoveredby warranty.
Projectorlamps(usedundernormalprojectoroperating conditions, not in excess of 8 hours per day and 260 days per year) are
coveredbywarrantyfor500hoursor90days, whichever comes first.
THEWARRANTYISINLIEUOFALLOTHER WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING BUT NOT
LIMITEDTOIMPLIEDWARRANTIESOFMERCHANTABILITYANDFITNESSFORA PARTICULAR PURPOSE. ANY REPRESENTATION
ORWARRANTY,ORAFFIRMATIONOFFACT,MADEBYANY SALES REPRESENTATIVE OR OTHER AGENT OF SMART, INCLUDING
BUTNOTLIMITEDTOSTATEMENTSREGARDINGCAPACITY, SUITABILITY FOR USE OR PERFORMANCE, EXPRESS OR IMPLIED,
WHICHISNOTSPECIFICALLYSETFORTHHEREINWILLNOTBE BINDING UPON SMART.
SMARThasnotauthorizedany other party to alter, modify, extend,enhance or limit the Warranty and SMART will not assume any
responsibilityorliabilityforanystatementsorrepresentationsmadebyanyother persons or entities.
RepairorReplace
ThePurchaser’sexclusiveremedyandSMART’ssole obligation duringthe Warranty Period shall be for SMART to repair or, at itsoption,
replacetheEquipmentthathasfailedorthathasproven to be defective at no cost to the Purchaser except for the one-way shippingcost of the
EquipmenttoaSMART-authorizedservice center. Any charges associatedwith a rush-requested order, such as air express, are the
responsibilityofthePurchaser.Priortoreturningany equipment under the Warranty, the Purchaser must render proof of the original
purchasedateandmustthereafterobtainfromSMARTaReturn of Merchandise Authorization (RMA) number. The RMA number shall
beclearlymarkedonthepackagingoftheEquipmentbeing returned.All returned Equipment that is replaced under the Warranty shall become
thepropertyofSMART.
LimitationofDamages
TheliabilityofSMARTtothePurchaserarisingoutofthe purchase and supplyoftheEquipmentoritsuse,whetherbaseduponWarranty,
contract,tort(including,withoutlimitation,negligence)orotherwise,shallnotin anycase exceed the original cost to thePurchaser of the
Equipment,anduponexpirationoftheWarrantyPeriodsuchliabilitywill terminate.
SMARTshallnotbeliable,whetherincontractoron any other basis, for any damagessustainedbythePurchaseroranyotherpersonarising
fromorrelatedtolossof use, failure or interruption in the operationof the Equipment, delay in repair or replacement or for incidental,
consequential,indirectorspecialdamagesorliabilities,lossof revenue, loss ofbusiness or other financial loss arising out of or in connection
withthesale,lease,maintenance,use,performancefailureorinterruptionof the Equipment.
WarrantyExclusions
TheWarrantywillnotapplytoandSMARTwillnot be liable for (i) any Equipment which is not purchased from an authorized SMARTdealer or
distributor;(ii)Equipmentthathasbeendamaged by accident, abuse, neglect, misuseorcauses other than ordinary use (see manuals that
shipwithEquipmentforfurtherdetail),includingthedirectapplication of any cleaning liquids, substances or abrasives to the hardware or onto
anydisplaysurfaceotherthanin accordance with the cleaning andcare instructions included in the User’s Guide for the Equipment;(iii)
Equipmentwhichhasbeenaltered,changed, serviced or repaired by anyone other than SMART-authorizedrepair personnel; or (iv)any
Equipmentonwhichtheserialnumberhasbeen defaced, modified or removed. Warrantyservice hereunder shall not operate to extendthe
originalWarrantyPeriod.TheWarranty excludesdamage incurred in shipment to or fromSMART. If the Equipment is received by the
Purchaserinadamagedcondition,the carrier and SMART must be notifiedimmediately. Purchaserslocated outside the U.S. or Canada
shouldinsteadcontactthecarrierandtheirSMARTdealeror distributor.
Third-PartyEquipmentWarrantyExtensionandException
ForequipmentsoldbySMARTto the Purchaserbut manufactured by a corporation other than SMART (such as wall-mounted cabinets,
carryingcasesandotherspecifiedcomponents),SMARTshallextendto thePurchaser, to the extent permitted, any and all applicablewarranty
provisionsprovidedtoSMARTbythe third-party manufacturer.The extension of any and all applicable third-party manufacturerwarranty
provisionsshallbeanexceptiontothisWarrantyandrepresentsSMART’s sole responsibility with respect to such equipment.
