Privacy and Data Protection
With regards to the Processing of Personal Data, Parties acknowledge and agree that they shall: (i) respectively comply with Applicable
Data Protection Law; and (ii) be autonomously responsible to collect and further process Personal Data in accordance with requirements of
Applicable Data Protection Laws, in particular for justification of any transmission of such Personal Data to the other Party, including providing
any required notices and obtaining any required consents, and for its decisions concerning the Processing and use of the Personal Data;
and (iii) not do anything which may cause the other Party to infringe any Applicable Data Protection Law. Partner will inform the end-users
in writing and include a notice with respect to the collection of personal and usage data as follows: “Please be informed that Philips Lighting
will have access to your personal and usage data via the Hue bridge. In order to understand how Philips Lighting processes your personal
data and usage data please read respectively Philips Lighting’s privacy notice and terms of use which can be found on www.meethue.com.”

ment sur la justification de la transmission des données personnelles à l’autre partie, incluant la communication de toutes les notifications
obligatoires et l’obtention des autorisations obligatoires, et de leurs décisions personnelles à l’égard du Traitement et de l’utilisation des
données personnelles; et (iii) d’éviter toute action pouvant conduire l’autre partie à violer toute loi applicable à la protection des données.
Le partenaire informera les utilisateurs par écrit et inclura une note d’information au sujet de la collecte et de l’utilisation des données à
caractère personnel, comme suit: «Nous tenons à vous informer que Philips Lighting pourra accéder à vos données personnelles et les
utiliser à travers Hue Bridge. Pour comprendre comment Philips Lighting élabore vos données personnelles et les utilise, nous vous invitons

En lo que respecta al tratamiento de datos personales, las Partes convienen y estipulan que: (i) cumplirán respectivamente la ley aplicable sobre protección de datos; (ii) serán autónomamente responsables de la recogida y el posterior tratamiento de datos personales de conformidad con las
obligaciones establecidas por las leyes aplicables sobre protección de datos, especialmente en lo relacionado con la justificación de cualquier transmisión de dichos datos personales a la otra Parte, incluido el envío de todas las notificaciones obligatorias y la obtención de los consensos obli-
gatorios, así como sus propias decisiones respecto al tratamiento y el uso de datos personales; (iii) se abstendrán de cualquier acto que pudiera inducir a la otra Parte a incumplir cualquier ley aplicable sobre protección de los datos. El Socio informará a los usuarios finales por escrito e incluirá
una nota informativa respecto a la recogida de datos personales y su utilización, como se indica a continuación: “Le informamos que Philips Lighting tendrá acceso a sus datos personales y a los datos de utilización a través de Hue Bridge. Para comprender como Philips Lighting procesa sus

Schutz der Privatsphäre und der Daten
Angesichts der Verarbeitung der personenbezogenen Daten anerkennen und vereinbaren die Parteien, dass: (i) sie jeweils das auf den Datenschutz anwendbare Gesetz einhalten werden; (ii) sie eigenständig für das Erheben und anschließende Verarbeiten der personenbezogenen Daten
gemäß den Bestimmungen der auf den Datenschutz anwendbaren Gesetze verantwortlich sind, insbesondere im Zusammenhang mit der Begründung für jede Übermittlung besagter personenbezogener Daten an die andere Partei, einschließlich der Bereitstellung aller vorgeschriebenen
Benachrichtigungen und des Erhalts der vorgeschriebenen Zustimmungen, wie auch für die eigenen Entscheidungen hinsichtlich der Verarbeitung und der Verwendung der personenbezogenen Daten; (iii) sie von Handlungen absehen, die die andere Partei zum Verstoß gegen jedwedes
auf den Datenschutz anwendbare Gesetz verleiten könnten. Der Partner informiert die Endanwender schriftlich und legt einen Informationshinweis zur Erhebung und Nutzung der personenbezogenen Daten mit folgendem Wortlaut bei: “Wir informieren Sie, dass Philips Lighting über Hue
Bridge auf Ihre personenbezogenen Daten sowie auf die Nutzungsdaten zugreifen kann. Wenn Sie mehr über die Verarbeitung Ihrer personenbezogenen Daten und der Nutzungsdaten durch Philips Lighting erfahren möchten, lesen Sie bitte den Philips Lighting Informationshinweis und die
Nutzungsbedingungen auf der Website www.meethue.com.”

συμπεριλαμβανομένης της παροχής όλων των υποχρεωτικών ειδοποιήσεων και της λήψης των απαιτούμενων συναινέσεων, καθώς και για τις αποφάσεις τους σχετικά με την επεξεργασία και τη χρήση των προσωπικών δεδομένων και (iii) ότι θα αποφεύγουν ενέργειες που μπορεί
να οδηγήσουν τον άλλο Συμβαλλόμενο στην παραβίαση οποιασδήποτε ισχύουσας νομοθεσίας σχετικά με την προστασία των δεδομένων. Ο Συνεργάτης θα ενημερώσει τους τελικούς χρήστες εγγράφως και θα συμπεριλάβει μια δήλωση σχετικά με τη συλλογή των προσωπικών
δεδομένων και των δεδομένων χρήσης ως εξής: «Σας ενημερώνουμε ότι η Philips Lighting θα έχει πρόσβαση στα προσωπικά σας δεδομένα και στα δεδομένα χρήσης μέσω του Hue Bridge. Για να κατανοήσετε τον τρόπο με τον οποίο η Philips Lighting επεξεργάζεται τα προσωπικά
σας δεδομένα και τα δεδομένα χρήσης, διαβάστε τη δήλωση περί προστασίας του ιδιωτικού απορρήτου της Philips Lighting και τους όρους χρήσης, στη διαδικτυακή διεύθυνση www.meethue.com.»    
